25 <br /> 1 <br /> 2 VOTE: Ayes, 6; Nays, 1 (McKee) <br /> 3 <br /> 4 A motion was made by Commissioner Greene, seconded by Commissioner Bedford, to <br /> 5 amend rule 19(b)13 to read, "the motion to reconsider a previous action may be in order at the <br /> 6 same meeting at which the action was taken, or at a subsequent meeting. For certain types of <br /> 7 actions, the Board is limited in its ability to reconsider without following additional procedural <br /> 8 steps. For example, an ordinance amended or a permit issued following notice and hearing <br /> 9 requirements proscribed by ordinance or law cannot be modified without following procedures <br /> 10 similar to those followed in the initial consideration. Where a motion to reconsider is in order, it <br /> 11 must be made by a Board member who voted with the prevailing side on the action to be <br /> 12 reconsidered. Such a motion requires a second and the seconder may be any member of the <br /> 13 Board. When such a motion is made and seconded and stated by the chair, the question is, <br /> 14 "Shall the Board reconsider its action on the matter to which the motion is addressed?" If such a <br /> 15 motion fails, the matter is not reopened or reconsidered. If adopted, the motion is again on the <br /> 16 floor for consideration, discussion and action." <br /> 17 <br /> 18 John Roberts asked if all the current language is being eliminated or just the first <br /> 19 paragraph.
