Agenda materials for the meeting are available at: <br /> 4 http://orangecountync.gov/AgendaCenter/Planning-Board-26. <br /> 5 <br /> 6 Planning Director's Recommendation: The Planning Director recommends approval of the <br /> 7 Statement of Consistency, indicating the amendments are reasonable and in the public interest, <br /> 8 contained in Attachment 4 and the proposed ordinance contained in Attachment 5. <br /> 9 <br /> 10 Note Regarding Written Public Comments: Session Law 2021-35 (House Bill 812) became <br /> 11 effective on July 1, 2021. A portion of the amended law pertains to written comments for public <br /> 12 hearings held in remote meetings during declared emergencies. The Session Law updated the <br /> 13 parameters for public written comments. Written comments on the subject of the public hearing <br /> 14 can be submitted by interested persons until 24 hours prior to the scheduled time for the <br /> 15 beginning of the public hearing. <br /> 16 <br /> 17 Chair Price introduced Craig Benedict, Orange County Planning Director. <br /> 18 Craig Benedict said the amendment decriminalizes violations of the UDO. He said staff <br /> 19 went through the LIDO to remove any language about criminal penalties. He said this does not <br /> 20 change potential criminal penalties for violation of floodplain management, soil erosion and <br /> 21 sedimentation control, and stormwater regulations. He said these changes were mandated by <br /> 22 state law. He reviewed the County Manager's recommendations. <br /> 23 <br /> 24 A motion was made by Commissioner McKee, seconded by Commissioner Fowler, to <br /> 25 open the public hearing. <br /> 26 <br /> 27 Roll call ensued <br /> 28 <br /> 29 VOTE: UNANIMOUS <br /> 30 <br /> 31 PUBLIC COMMENT: <br /> 32 None. <br /> 33 <br /> 34 A motion was made by Commissioner Fowler, seconded by Commissioner Hamilton, to <br /> 35 close the public hearing. <br /> 36 <br /> 37 Roll call ensued <br /> 38 <br /> 39 VOTE: UNANIMOUS <br /> 40 <br /> 41 A motion was made by Commissioner Bedford, seconded by Commissioner Fowler, to <br /> 42 approve the statement of consistency and the ordinance approving the UDO text amendments. <br /> 43 <br /> 44 Roll call ensued <br /> 45 <br /> 46 VOTE: UNANIMOUS <br /> 47 <br /> 48 b.
