The common areas cannot be subdivided or recombined with adjacent lots. Draft farms of <br />the Homeowners Association documents, including restrictive covenants and conservation <br />easements, that contain use and maintenance provisions for the open space and buffers <br />must be submitted for review by the County Attomey as pad of the preliminary plat approval <br />process. The restrictive covenants or conservation agreement shall designate a backup <br />grantee in the event that the Homeowners Association is eliminated. <br />6. The preliminary and final plats shall contain a note restricting further subdivision. <br />7. Each lot shall contain an adequate area for scene disposal and a repair area as approved by <br />the Orange County Division of Environmental Health. <br />B. The preliminary plat shall indicate areas for on -site infiltration of storm water that <br />demonstrates compliance with Article 623.3a of the Orange County Zoning Ordinance. <br />9. The location of all dramageways, stream buffers and flood plains shall be delineated on the <br />preliminary and final plats, along with appropriate information regarding restrictions. <br />10. The developer shall establish a building limit line along the eastern edge of Iota 1 -14 to <br />eliminate any flood potential from the drainageway and beaver pond. This line should be <br />shown on the preliminary and final plats. <br />11. The preliminary plat shall show the location of tree protection fencing and contain a note <br />requiring the installation of tree protection fencing prior any grading to ensure the <br />protection of vegetation within all buffers and open space. <br />12. The applicant shall dedicate a minimum of 19,869 square feet (1/57 acre per readdenfial lot) <br />for public recreation space , of pay an in- lieu -of fee, as part of the preliminary plat approval <br />process. (Section IV -13-7 -b Recreation Sites, Orange County Subdvisron Regulations). <br />13, The applicant shall provide a minimum of 43,293 square feet for private recreation space as <br />pad of the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange <br />County Subdivision Regulations). <br />14. All street names ro be reserved with CIS section of Planning Department prior to submittal of <br />preliminary plat subdivision request. <br />Second Action: Planning Board to consider Preliminary Plat <br />The Planning Board recommended approval of the preliminary plat for Birdsong <br />Subdivision on September 5, 2001 in accordance with the attached Resolution for <br />Approval. <br />• Third Action: <br />Board of County Commissioners consideration of Preliminary Plat <br />1, The Board shall consider the application within a reasonable amount of time. <br />2. During deliberations and consideration of the application the Board may defer <br />consideration at any point to pursue additional analysis and review. <br />3. If the Preliminary Plat is approved by the County Commissioners the applicant shall have <br />one (1) year to prepare and file a Final Plat or to request a one -year extension from the <br />Planning Director <br />FINANCIAL IMPACT: Fiscal Impact Analysis (attached). <br />
