The <br />question of open buming cf landclearing debris can ba resolved and/or addressed by other <br />means or through a future amentlmen[to the RRMO. It is suggested that proceeding In this <br />manner would allow stall time to more thoroughly examine the issues related to prohibiting [he <br />open buming of agriculturally genereletl lantlcleadng tlebds. These issues wroultl specifically <br />include: <br />• How would the agricultural wmmunity be impacted by the prohibition cf open burning of <br />landclearing debris? <br />• How could the ortlinance be modified to make specific accommodations to the agricultural <br />communiq? <br />What alternatives to open buming could be made available to the agricplturel community <br />should the BOCC proceed to prohibit open buming of all landclearing debris? <br />• Are options available to subsidize costs to the agriculWral community tha[are associated <br />wRh alternatives tc open buming? <br />• What is the estimated amount of land cleared on an annual basis for agriculture activities? <br />• Could the "use value'tax designation be utilized in consitledng special accomnwtlations for <br />agdcultursl burning4 <br />Are there other means available, aside from the RRM Okinance, that mould be considered <br />in pursuing regulation cf the open burning of landclearinq debtls9 <br />These and other questions could be addressed in a future analysts of the issue of regulating <br />open burning of landclearing debris in Orange County. Should the BOGG agree to this <br />approach, stall mould return by the first BOCC meeting In Febmary 2002 with a comprehensive <br />report cn the subject. This would provide the BOCC with sufficient time to amend any <br />previously adopted odinance, prior to its anticipated July 1 effective date, to include provisions <br />to regulate the burning of landclearing debris. Additionally, it would allow time to develop <br />alternatives to open buming for the agricultural community. <br />Implementation of this ortlinance would require the immediate creation of a new permanent <br />position to handle bath education end enforcement activities related to management of <br />cona[mction 8 demolition waste. The C8D Waste ftecyclinq Task Force recommended such a <br />position, and funding far the position was indutletl in the 2001-02 Solid W as[e operating <br />budget, pending formal approval of the RRMO by the Board of Commissioners. Copies of <br />pertinent 2001-02 budget background matedals related to this new position are included as an <br />atlachment to this abstract. <br />Other modifications to the current draft of the ordinance include addition of an effective date of <br />July 1, 2002. While the education proceea would begin immediately upon adoption, stall is <br />assuming the[ actual enforcement and imposition of penalties would commence July 1. <br />Alfematively, the odinance could be prepared so sa to become effective immediately, but refer <br />to s apecifc grace pedotl ending on a date certain. <br />Atltlitionally, the references W a 525 fee for issuance of a license (per vehicle) and for permd <br />applications has been modified to reference a BOCC approved tee schedule. Staff believes <br />this to be prudent so that the odinance would not require amending simply to change a fee. <br />
