No payment by the Owner will be made for any material not physically located on the site unless <br />the storage of such material can be verified by the Designer and is marked specifically for the <br />project use and scheduled for installation within 30 days of payment request. <br /> <br />1.03 SUBSTITUTIONS AND PRODUCT OPTIONS <br /> <br />A. Products Specified by Reference Standards or by Description Only: Provide a product meeting <br />those standards. The Owner and Engineer reserve the right to require confirmation by the roof <br />manufacturer that their system/products intended for use meet the requirements of the <br />specifications prior to award of the contract. Failure of the contractor to provide requested <br />confirmation may result in disqualification of their bid. <br /> <br />B. Products Specified by Naming Several Manufacturers: Provide a product of named <br />manufacturers meeting specifications: Requests for product substitutions must be made in <br />writing for any manufacturer not specifically named in accordance with the following <br />requirements in paragraphs 1.03C, D, E, F, and G. When a minimum of three approved <br />manufacturers/products are listed, the Engineer reserves the right to not accept any <br />requests for manufacturer/system substitutions. <br /> <br />C. If the Engineer will allow requests for substitution of the roof membrane/system and <br />manufacturer from those listed in the applicable section of these specifications, requests must be <br />submitted no less than ten (10) days prior to the bid date. Requests must be made by the <br />Contractor, requests from suppliers or manufacturers will not be reviewed. <br /> <br />D. Each written request for a substitution shall be submitted with complete data substantiating <br />compliance of proposed substitution with the technical specifications and drawings. A chart <br />comparing the warranty, technical data, etc. comparing the two materials must be submitted. <br /> <br />E. The request shall constitute that the Contractor: <br /> <br />1. Has investigated the proposed product and determined that it meets or exceeds, in all <br />respects, specified product. <br />2. Will provide the same warranty as the specified product. <br />3. Will coordinate installation and make any other change that may be required for work to <br />be complete with substituted item. <br />4. Waives claims for additional costs that may subsequently become apparent due to use of <br />substituted item. <br /> <br />F. Substitutions will not be considered when they are included without identification as a <br />substitution or implied on shop drawings or product data submittals without separate written <br />request, or when acceptance will require substantial revision of technical specifications. <br /> <br />G.
