106 <br /> GENERAL ASSEMBLY OF NORTH CAROLINA <br /> SESSION 2007 <br /> SESSION LAW 2007-328 <br /> SENATE BILL 398 <br /> AN ACT to allow the citizens of union county to determine if district representation should be <br /> implemented for the union county board of commissioners. <br /> The General Assembly of North Carolina enacts: <br /> SECTION 1. [extraneous] <br /> SECTION 2. Effective the first Monday in December 2008, the membership of the Union <br /> County Board of Commissioners shall be increased by two members. Effective the first Monday <br /> in December 2008, the membership of the Union County Board of Commissioners shall consist <br /> of two members elected at large and five members elected from electoral districts as set out in <br /> this act. <br /> SECTION 3.For the purpose of nominating and electing members of the Union County Board <br /> of Commission in 2008, and periodically thereafter, Union County shall be divided into the <br /> following districts with each district electing one commissioner: <br /> [detailed census block descriptions of the new districts] <br /> SECTION 4. [setting up staggered terms] <br /> SECTION 5. In accordance with G.S.153A-22, the electoral districts as set out in Section 2 of <br /> this act may be redrawn as required by federal and State law following each decennial federal <br /> census. <br /> SECTION 6. The Union County Board of Elections shall place on the ballot, on the first <br /> Tuesday following the first Monday in November 2007, a referendum for the purpose of <br /> submission to the qualified voters of Union County the question of whether or not the structure <br /> of the board of county commissioners shall be altered to increase the number of commissioners <br /> to seven and create electoral districts. The Union County Board of Elections shall adopt a <br /> procedure to provide for legal notice of the referendum consistent with the intent of Chapter 163 <br /> of the General Statutes. <br /> SECTION 7. In the election, the ballot question shall be separate from other ballot questions, <br /> and the question on the ballot shall be: <br /> "Shall the structure of the county board of commissioners be altered such that the number of <br /> commissioners is increased to seven and electoral districts are created. <br /> [ ] FOR [ ] AGAINST" <br /> 5 <br />
