26 <br /> WHEREAS, the General Statute directs the Department to <br /> present "actions which might preclude the need for additional <br /> regulation. " <br /> WHEREAS, the voluntary plan, if adhered to by those involved, <br /> satisfactorily addresses the capacity use-related problems in the Eno <br /> River area. <br /> NOW THEREFORE, BE IT RESOLVED that the EMC accepts the Eno <br /> River Capacity Use Investigation Hearing Officer' s Report and <br /> endorses the voluntary Water Management Operations Plan and <br /> directs the staff of the Division of Water Resources to monitor <br /> compliance with the plan and make periodic reports to the EMC. <br /> BE IT FURTHER RESOLVED, that should the plan not be adhered <br /> to by those involved, that the EMC intends to proceed with a <br /> designation of capacity use for the Eno River area, as outlined <br /> in the Department' s report. <br /> This the 8th day of September 1988 . <br /> Charles L.
