DSS Skills Development Center Smith Sinnett / 2020045 <br />Chapel Hill, North Carolina Orange County <br /> <br /> <br />SPECIAL CONDITIONS 00 90 10 - 1 <br /> <br />SECTION 00 90 10 - SPECIAL CONDITIONS <br /> <br />The following requirements are, in fact, Conditions of the Contract, and are in addition to the General Conditions, <br />Supplementary General Conditions and Special Conditions and are not intended to replace or otherwise conflict with <br />those Conditions. These Special Requirements are particular to the Work of this Project and are intended to inform <br />the Contractor of non-standard conditions affecting the Work of the Contract. <br /> <br />ARTICLE 1 - QUALIFICATION OF PROJECT SUPERINTENDENT <br /> <br />The Contractor shall be required to demonstrate his capability to provide a qualified project superintendent for <br />the project who is acceptable to the Owner and Architect. The project superintendent shall have at least five <br />years of successful experience on projects of similar size, scope and nature. Contractor shall be required to <br />substantiate these qualifications with a written submittal within seven calendar days after opening of the Bids. <br />The Contractor is charged with providing a qualified and experienced superintendent for this project to the <br />satisfaction of the Owner and Architect. The Owner reserves the right to disapprove a proposed superintendent <br />who does not appear to be fully qualified and experienced to accomplish the work of this project. <br /> <br />ARTICLE 2 - SINGLE PRIME AND SEPARATE PRIME CONTRACT BIDS <br /> <br />Bids will be received for Single Prime Contracts only. Opening of Bids, as it relates to the number of bids <br />required to allow opening, and award of Contracts, as it relates to low bid and the number of bids required to <br />allow award, shall be governed by the guidelines and procedures recommended by the State Department of <br />Construction of the N.C. Department of Administration for bid openings for single prime informal contract bids. <br /> <br />Those Bidders submitting Single Prime Contract bids shall be aware that all work of the project is included in <br />the Work of a Single Prime Contractor, regardless of the divisions of work indicated on the Drawings and in the <br />Project Manual. All references and indications in the Drawings and the Project Manual to Separate Prime <br />Contracts shall apply to the Single Prime Contract. <br /> <br />Single Prime Contract Bidders must include the names of their major subcontractors on the Proposal form as <br />indicated, to include Plumbing and Electrical. <br /> <br />All Allowances identified shall all be included in the Single Prime Contract Bid. <br /> <br />ARTICLE 3 - COORDINATION AND COOPERATION WITH OTHER CONTRACTORS <br /> <br />Prime Contractor shall be aware that the Owner has or may engage other contractors to accomplish work <br />concurrently with the Work of this project, which will have a direct effect on the accomplishment of the Work <br />of this project. Contractors will be required to cooperate and coordinate with these other contractors during the <br />course of the project to avoid delays in the work of this project of that of the other contractors. <br /> <br />ARTICLE 4 – RESERVED <br /> <br />ARTICLE 5 - RESERVED <br /> <br />ARTICLE 6 - AMERICANS WITH DISABILITIES ACT (ADA) <br /> <br />It is the design intent of this project to comply with the Americans with Disabilities Act and Chapter 11 of the <br />North Carolina Building Code 2012 and ANSI ICC A117.1-2009. All items and assemblies manufactured or <br />fabricated for installation on this project shall be ADA compliant. Shop drawing submittals shall indicate ADA <br />compliance. Installation of all items and assemblies shall be ADA compliant. All contractors shall submit a <br />statement that all work to the best of their knowledge is ADA compliant prior to release of final retainage. <br />Remedy of non-compliant circumstances should they arise shall consist of written notification to the Architect <br />by the Contractor prior installation or fabrication of the respective building component or arrangement.
