AGENCY shall be responsible for providing <br />AVL Data to the TouchPass System on an ongoing basis. To facilitate TouchPass <br />System receipt of AVL Data, the AGENCY shall provide Delerrok with access to <br />AVL system compatible with the TouchPass System, and Delerrok shall perform <br />a one-time integration of the TouchPass System with that AVL system. <br />AGENCY shall be responsible for providing AVL Data to the TouchPass System <br />on an ongoing basis. <br />The AVL Integration fee is per integration but will not be applicable if the <br />Agency-provided information is available via a real-time file feed that is <br />compliant with the General Transit Feed Specification – Real Time (GTFS-FT) <br />or an AVL system for which integration has previously been completed by <br />Delerrok and that integration can be confirmed to be applicable to Agency’s <br />AVL system. <br />v. Modem Integration (Optional). AGENCY shall provide access to cellular <br />modems and antennas that meet or exceed Delerrok’s requirements. In the event <br />AGENCY selects a modem that has not yet been integrated to the TouchPass <br />System, Delerrok shall work with the AGENCY to perform one-time integration <br />of AGENCY modems to facilitate use for communications between Readers and <br />the TouchPass System. Delerrok shall provide to AGENCY a list of the currently <br />integrated modem makes and models upon request. <br />The Modem Integration fee is per integration with each unique modem type but <br />will not be applicable if integration of the agency-selected modem type has <br />previously been completed by Delerrok and can be confirmed to be applicable to <br />Agency’s modem type. <br />c. Standard Services <br />i. TouchPass Support Services. Delerrok shall provide the following maintenance <br />and support services beginning from the Launch Date: <br />A. Maintain the TouchPass System so that it operates in conformity, in all <br />material respects, with the descriptions and specifications for the <br />TouchPass Hosted Services set out in the Agreement, or as may be <br />modified from time to time by Delerrok as a result of updates and <br />upgrades; <br />B. In the event that AGENCY detects any errors or defects in the TouchPass <br />Hosted Services, Delerrok will use its commercially reasonable efforts to <br />provide support services through a telephone software support line from <br />Monday to Friday, 8 am to 8 pm Pacific Time (excluding North <br />American holidays). <br />C. Use commercially reasonable efforts to downgrade any major issues in <br />the TouchPass Hosted Services to a minor issue within 24 hours. Major <br />issues are defined as issues that prevent passengers from using the <br />TouchPass Hosted Services or prevent AGENCY from collecting <br />revenue, that are not a Support Exclusion. <br />D. Use commercially reasonable efforts to resolve any minor issues in the <br />TouchPass Hosted Services within 30 days. Minor issues are defined as <br />issues that do not affect passengers or revenue collection but could affect <br />AGENCY’s use of the TouchPass Hosted Services (e.g. data collection) <br />that are not a Support Exclusion. <br />E.
