the Mortgaged Property, and the activities at the Mortgaged Property, in compliance <br /> with all environmental laws, rules, and regulations. The County will, in a timely <br /> manner, take all lawful action necessary to maintain compliance or to remedy any <br /> lack of compliance. <br /> (c) The County will use and maintain Hazardous Materials on the <br /> Mortgaged Property only for the routine maintenance and operation of the <br /> Mortgaged Property. The County will maintain these Hazardous Materials only in <br /> appropriate quantities for these purposes, and will use them only in substantial <br /> compliance with label instructions and all State and federal environmental laws, <br /> rules and regulations. The County will not use the Mortgaged Property (A) for the <br /> manufacture, transport, process, storage, treatment or disposal of any Hazardous <br /> Materials or (B) for any industrial, manufacturing or landfilling use or for any <br /> chemical production. <br /> (d) The County will promptly send to the Trustee, upon the Trustee's <br /> request, copies of any citations, orders, notices or other material governmental or <br /> other communication received with respect to any Hazardous Materials. <br /> For the purposes of this Section, "Hazardous Materials" means any chemicals, <br /> materials, substances, wastes or other substances that are classified and regulated <br /> by any by federal, State or local laws as hazardous or toxic substances that exist on <br /> or affect the Mortgaged Property. <br /> Section 6.03. County's Undertaking for Continuing Disclosure. The <br /> County undertakes, for the benefit of the beneficial owners of the Bonds, to provide <br /> the following items and information to the MSRB: <br /> (a) by not later than seven months from the end of each of the County's <br /> Fiscal Years, beginning with the Fiscal Year that ends June 30, 2021, audited County <br /> financial statements for such fiscal year, if available, prepared in accordance with <br /> Section 159-34 of the General Statutes of North Carolina, as it may be amended from <br /> time to time, or any successor statute, or, if such audited financial statements are <br /> not available by seven months from the end of any fiscal year, unaudited County <br /> financial statements for such fiscal year, to be replaced subsequently by audited <br /> County financial statements to be delivered within 15 days after such audited <br /> financial statements become available for distribution; <br /> 27 <br />
