For sinuous <br /> channels, multiply allowable velocity by 0.95 for slightly sinuous channels, by 0.9 for <br /> moderately sinuous channels, and by 0.8 for highly sinuous channels. <br /> (4) Exceptions <br /> This rule shall not apply in areas other than the University Lake, Cane Creek, and Upper <br /> Eno Watersheds where it can be demonstrated that stormwater <br /> runoff velocities will not create an erosion problem in the receiving watercourse. <br /> 6.15.9 Responsibility for Installation and Maintenance <br /> (A) On-Site Facilities <br /> (1) During the development of a site, the person engaged in or conducting the land- <br /> disturbing activity shall be responsible for installing and maintaining all temporary <br /> and permanent erosion and sedimentation control measures and facilities as <br /> required by the approved or revised F=FGSOon-erosion and sedimentation Centre! <br /> W,arncontrol plan, any provision of this Ordinance, the Act, or any order adopted <br /> pursuant to this Ordinance or the Act. <br /> (2) The responsibility for installing and maintaining permanent erosion and <br /> sedimentation control measures and facilities after completion of the site <br /> development shall lie with the land owner or person in possession or control of <br /> the land except facilities and measures installed within road or street rights-of- <br /> way or easements accepted for maintenance by a government agency. <br /> (B) Off-Site Facilities <br /> (1) The Erosion Control Officer may allow stormwater runoff that is charged in <br /> volumes or at rates in excess of those otherwise allowed by this Ordinance to be <br /> discharged into drainage facilities off the site of development if the off-site <br /> facilities and the channels leading to them are designed, constructed, and <br /> maintained in accordance with the standards of this Ordinance. <br /> (2) Adequate provision must be made for the sharing of the construction and <br /> maintenance expenses of the facilities. <br /> Orange County, North Carolina—Unified Development Ordinance Page 6-130 <br />
