Article 6: Development Standards 81 <br /> Section 6.15: Soil Erosion and Sedimentation Contro1201 F <br /> of discharge so as to minimize accelerated erosion of the site and increased <br /> sedimentation of the stream. <br /> (8) Open Burning <br /> The erosion and sedimentation control P-4a+pplan shallould225 specify the method <br /> of disposal of trees, limbs, stumps and construction debris associated with the <br /> aGtivltyland-disturbing activity; which shall be by some method other than open <br /> burning. <br /> (B) Mandatory Design and Performance Standards for Land-Disturbing Activity <br /> No land-disturbing activity subject to the provisions of this Section shall be undertaken <br /> except in accordance with the following mandatory standards: <br /> (1) Buffer Zone <br /> (a) No land-disturbing activity,,,,ring periods ^f ()RStF ,GtiE)R OF iMprevemeRt <br /> to 4aad 2-26-shall be permitted in proximity to a lake or natural watercourse <br /> unless a buffer zone is provided along the margin of the watercourse of <br /> sufficient width to confine visible siltation within the 25% of the buffer <br /> zone nearest the land-disturbing activity. <br /> (b) Unless otherwise provided, the width of a buffer zone is measured from <br /> the edge of the water to the nearest edge of the disturbed area, with the <br /> 25% of the strip nearer the land--disturbing-activity containing the natural <br /> or artificial means of confining visible siltation. <br /> (c) Waters Classified as Trout Waters by the Environmental Management <br /> Commission <br /> (i) Waters that have been classified as trout waters by the <br /> Environmental Management Commission shall have an <br /> undisturbed buffer zone 25 feet wide or of sufficient width to <br /> confine visible siltation within the 25% of the buffer zone nearest <br /> the land-disturbing activity, whichever is greater. <br /> (ii) The 25 foot minimum width for an undisturbed buffer zone <br /> adjacent to designated trout waters shall be measured <br /> horizontally from the top of the bank. <br /> (iii) T*K,-0range27 County may approve plans which include land- <br /> disturbing activity along trout waters when the duration of said <br /> dost,� e land-disturbing activity would be temporary and the <br /> extent of said dna t g land-disturbing activity would be <br /> minimal. This subsection shall not apply to a land-disturbing <br /> activity in connection with the construction of facilities to be <br /> located on, over, or under a lake or natural watercourse. <br /> (iv) Where a temporary and minimal disturbance land-disturbing <br /> activity is permitted as an exception by Section <br /> 6.15.7(B)(1)(c)(iii)of this Ordinance, land-disturbing activityles in <br /> the buffer zone adjacent to designated trout waters shall be <br /> limited to a maximum of 10% of the total length of the buffer <br /> zone within the tract to be disturbed, such that there is not more <br /> than 100 linear feet of disturbance in each 1,000 linear feet of <br /> buffer zone.
