Article 6: Development Standards 79 <br /> Section 6.15: Soil Erosion and Sedimentation Control201 F <br /> (B) Erosion and Sedimentation Control Plan Requirement <br /> (1) Except as otherwise provided in Section 6.15.6(C) of this Ordinance218, an <br /> erosion and sedimentation control plan shall be prepared and.19filed with and <br /> approved by the Erosion Control Division prior to the commencement of any <br /> land-disturbing activity within the University Lake, Cane Creek, and Upper Eno <br /> Watersheds. <br /> (2) The erosion and sedimentation control P--lanIp an shall specify the method of <br /> disposal of trees, limbs, stumps and construction debris associated with the <br /> activity; which shall be by some method other than open burning. <br /> (C) Erosion and Sedimentation Control Plan Waiver <br /> (1) The person(s) conducting the land-disturbing activity need not submit an €resieR <br /> erosion and sedimentation SeetrelPlaecontrol plan if such person obtains an <br /> Eresiererosion and sedimentation SeetrelPlaecontrol plan Waiverwaiver from <br /> the Erosion Control Division. <br /> (2) An application for this waiver shall be submitted to the Erosion Control Officer <br /> and shall contain the following: <br /> (a) The name, address, and phone number of the developer and owner, <br /> (b) A description and drawing of the proposed development or activityland- <br /> disturbing activity, <br /> (c) The location of the development, and <br /> (d) Any other information requested by the Orange County Erosion Control <br /> Officer that is reasonably necessary to evaluate the proposed <br /> development. <br /> (3) The Erosion Control Officer shall issue the erosion and sedimentation control <br /> PIaR Waive plan waiver if he/she finds the following: <br /> (a) The land-disturbing activity will not result in the uncovering of more than <br /> 10,000 square feet; and <br /> (b) The land-disturbing activity is not to be conducted in connection with any <br /> of the following types of developments: <br /> (i) Shopping centers, <br /> (ii) Industrial and commercial facilities, <br /> (iii) Major subdivisions, <br /> (iv) Roads, or <br /> (v) Any activity involving the temporary or permanent storage <br /> (above or below ground) of any noxious, toxic, or hazardous <br /> substance, including fuel storage facilities. <br /> (c) The proposed land-disturbing activity will not: <br /> (i) Significantly increase or decrease the rate or volume of surface <br /> water runoffs; <br /> (ii) Significantly contribute to the degradation of water runoffs; <br /> (iii) Have a significant adverse impact on a wetland, watercourse, or <br /> water supply reservoir,; <br /> Zls consistent reference to"this Ordinance". <br /> 219 Text correction—deleted "prepared and". <br /> Orange County, North Carolina—Unified Development Ordinance Page 6-118 <br />
