Article 6: Development Standards 78 <br /> Section 6.15: Soil Erosion and Sedimentation Contro1201 F <br /> (D) State Jurisdiction <br /> Those land-disturbing activities over which the State by statute (G.S. 113A-56(a)) has <br /> exclusive regulatory jurisdiction, which are activities: <br /> (1) Conducted by the State, <br /> (2) Conducted by the United States, <br /> (3) Conducted by persons having the power of eminent domain, <br /> (4) Conducted by local governments, or <br /> (5) Funded in whole or in part by the State or the United States. <br /> 6.15.5 General Requirements for Areas Other Than University Lake, Cane Creek, and Upper Eno <br /> Watersheds <br /> (A) Protection of Property <br /> (1) Person(s) conducting land-disturbing activityies shall take all reasonable <br /> measures to protect all public and private property from damage by such <br /> aGtiVitieeland-disturbing activity. <br /> (2) The disposal of trees, limbs, stumps and construction debris associated with the <br /> aTland-disturbing activity shall be by some method other than open <br /> burning. <br /> (3) This requirement shall apply to any areas to be disturbed, regardless of the size <br /> of the area to be uncovered. <br /> (B) Erosion and Sedimentation Control Plan Requirement <br /> (1) Prior to the commencement of any land-disturbing activity that will result in the <br /> uncovering of more than 20,000 square feet of land, the person(s) conducting the <br /> land-disturbing activity must prepare and submit an Eresiererosion and <br /> sedimentation control planCE)Rtrsl Plae for the proposed site. <br /> (2) The erosion and sedimentation control planP4arn shall specify the method of <br /> disposal of trees, limbs, stumps and construction debris associated with the <br /> activity; which shall be by some method other than open burning. <br /> (3) The erosion and sedimentation control planP4arn must be approved and aid <br /> Disturbing oormi an LDP obtained prior to the start of the d-isturba-nGeland- <br /> disturbing activity. <br /> 6.15.6 General Requirements for University Lake, Cane Creek, and Upper Eno Watersheds <br /> (A) Protection of Property <br /> (1) Person�s)Z--5 conducting land-disturbing activity shall take all reasonable <br /> measures to protect all public and private property from damage by such <br /> t'vittesland-disturbing activity. <br /> (2) The disposal of trees, limbs, stumps and construction debris associated with the <br /> land-disturbing activity shall be by some method other than open burning,2'6 <br /> (3) This requirement shall apply to any areas to be disturbed, regardless of the size <br /> of the area to be uncovered.217 <br /> (2) This requirereept shall apply to aRy aFea to be disturbed. <br /> Zls Text correction—added parenthesis for consistency with previous sub-section. <br /> 216 Added Item 2 and Item 3 for consistency with Section 6.15.5 (A)of this Ordinance. <br /> 217 Added Item 2 and Item 3 for consistency with Section 6.15.5 (A)of this Ordinance. <br /> Orange County, North Carolina—Unified Development Ordinance Page 6-117 <br />
