Article 5: Uses 47 <br /> Section 5.12: Standards for Extractive Uses <br /> (2) An EFGS2GRrerosion and sedimentation control plan90 has been <br /> approved by the Department„+G.,,,,-,,.,M8Rt Health and Nat ral Reso FGeS; <br /> Department of Environment Mineral and Land Resources (DEMLR).91 <br /> (3) The material extracted is to be used solely for a State or Federal road <br /> construction project; and <br /> (4) Road construction plans include provision for reclaiming the excavated area. If <br /> the reclamation plan involves filling the excavated area, the fill material must be <br /> inert material defined as beneficial fill by the Solid Waste Branch of the <br /> Department of Environment and Natural Resources, provided that the debris is <br /> also associated with a State or Federal Highway road construction project. <br /> Inclusion of reusable or recyclable materials in the reclamation or filling of the <br /> borrow pit should be minimized. A proposed debris recycling program or a <br /> statement as to why material will not be recycled must be submitted for review by <br /> Orange County. <br /> 5.12.2 Extraction of Earth Products <br /> (A) Use Standards <br /> (1) Processing of materials on-site, beyond incidental mechanical consolidation or <br /> sorting to facilitate transportation off-site for further processing, is prohibited. <br /> (B) Submittal Requirements and Standards of Evaluation for NR-CD District <br /> (1) Submittal Requirements <br /> In addition to the information required by Section 2.9, the following shall be <br /> submitted as part of the application: <br /> (a) 26 copies of the site plan, prepared by an appropriately licensed <br /> professional, which shall contain the following: <br /> (i) Extent of area to be excavated or mined. <br /> (ii) Aerial photograph of site and all areas within 1,000 feet of the <br /> perimeter of the property flown within two months of the <br /> application for a Special Use Permit. <br /> (iii) Existing topography at a contour interval of two feet based on <br /> mean sea level datum. <br /> (iv) Land use, road system, natural features and topographical ten <br /> foot contour intervals) details for the area within 1,000 feet of the <br /> perimeter of the property. <br /> (v) Typical cross sections showing extent of overburden, extent of <br /> sand and gravel deposits, and water table. <br /> (vi) Proposed handling and storage areas for overburden, by <br /> products and excavated materials. <br /> (vii) Location and results of groundwater borings showing depth of <br /> groundwater. <br /> (viii) Any areas proposed for ponding. <br /> (ix) Wind pattern details and on site windbreaks. <br /> (x) Soils details and statement addressing agricultural productivity <br /> and reclamation. <br /> 90 Consistent reference to"erosion and sedimentation control plan". <br /> 91 Reflects current name of Department. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-94 <br />
