Article 2: Procedures 23 <br /> Section 2.19: Soil Erosion and Sedimentation Control Plans <br /> (4) If the applicant is not the owner of the land to be disturbed, the draft Eresien <br /> erosion and sedimentation control planGGRtrel Rlae must include the owner's <br /> written consent for the applicant to submit a draft Erosion erosion and <br /> sedimentation control planSentrol Plan and to conduct the anticipated land- <br /> disturbing aG#v4land-disturbing activity. <br /> 2.19.4 Review by the Soil &Water Conservation District <br /> (A) The Orange Soil and Water Conservation District shall review the €resion erosion and <br /> sedimentation control planSontrol Plan and submit any comments and recommendations <br /> to the Erosion Control Officer within 20 days after the Soil and Water Conservation <br /> District received the €resienerosion and Sedimentation Control Plan control plan, or <br /> within any shorter period of time as may be agreed upon by the District and the Erosion <br /> Control Officer. <br /> (B) Failure of the Soil and Water Conservation40 District to submit its comments and <br /> recommendations to the Erosion Control Officer within 20 days or any agreed- upon <br /> shorter period of time shall not delay final action on the Eresien erosion and <br /> sedimentation control planCentFel Plan. <br /> 2.19.5 Review and Response to Erosion and Sedimentation Control Plans <br /> (A) The Erosion Control Officer shall review each complete Eresien erosion and <br /> sedimentation control planCentrel Rlae submitted and within 30 days of receipt thereof <br /> will notify the person submitting the p{a-R-erosion and sedimentation control plan that it <br /> has been: <br /> (1) Approved, <br /> (2) Approved with modifications, <br /> (3) Approved with conditions, <br /> (4) Approved with performance reservations, or <br /> (5) Disapproved. <br /> (B) Examples of conditions of approval are, but not limited to: <br /> (1) Channel stabilization must be successful or another type of lining must be used; <br /> (2) Delineating certain areas to be graded and stabilized within a specified number <br /> of days to reduce the potential for erosion and protect critical areas; <br /> (3) Providing a performance security to provide permanent ground cover; and/or <br /> (4) Requiring the person finannially responsib4efinancially responsible party to retain <br /> the services of a professional engineer or architect to supervise implementation <br /> of the approved EFesion erosion and sedimentation control plancentrel Plan. <br /> (C) Disapproval of an erosion and sedimentation control planes must specifically state in <br /> writing the reasons for disapproval. <br /> 2.19.6 Timeframe for Review of Erosion and Sedimentation Control Plans 41 <br /> Failure to approve, approve with conditions, approve with modifications or disapprove a complete <br /> EFOSOOrerosion and sedimentation control planSentrel Plae within 30 days of receipt of the <br /> complete erosion and sedimentation control an plae-shall be deemed an approval of the erosion <br /> and sedimentation control plan. <br /> 40 Text correction -clarification. <br /> "Text correction—added "s". <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-65 <br />
