Article 2: Procedures 17 <br /> Section 2.18: Land Disturbing Permits (LDPs) <br /> The vacated plat shall be approved under the procedures for which the original plat was <br /> approved. The approving entity shall approve or deny an application for a plat vacation. <br /> (B) Road abandonment <br /> (1) A major subdivision road that is dedicated to the public but not yet accepted by <br /> NCDOT shall not be abandoned without approval from the Board of County <br /> Commissioners. <br /> (2) Roads dedicated to the public, but not open or used within 15 years after <br /> dedication, may be withdrawn in accordance with NCGS 136-96 without NCDOT <br /> or County approval. <br /> 2.17.5 Approval Criteria <br /> (A) No application for a plat vacation shall be approved unless it complies with all applicable <br /> requirements of this Ordinance. <br /> (B) The approving entity shall not approve an application for a plat vacation if it will materially <br /> injure the rights of any non-consenting property owner or any public rights related to <br /> public improvements unless expressly agreed to by the agency with jurisdiction over such <br /> improvements. <br /> 2.17.6 Recording <br /> (A) After the new plat is approved, the plat must be recorded, within 60 days, with the <br /> Register of Deeds Office. <br /> (B) Upon the execution and recording of the new plat, the vacated plat has no effect. <br /> (C) The re-subdivision of the land covered by a plat that is vacated shall be platted in the <br /> same manner as is prescribed by this Article for an original plat. <br /> 2 <br /> Sectior 2.18-. LAND DISTURBING PERMITS <br /> 2.18.1 Generally <br /> (A) Before commencement of any land-disturbing activity in excess of the thresholds as <br /> defined in the Orange County Watershed Matrix Table (Table 2.18.1.E of this Ordinance), <br /> feet,starting a land disturbing activity greater than 20,000 square <br /> or greater than 10,000 <br /> square feet i University within the niyer�yUpper Lake Cone Creel or G <br /> q uonn Watershedj_z, the <br /> owner or his/her duly appointed agen financially responsible party shall obtain a Land <br /> Disturbing Permit LDP from the Erosion Control Officer.
