Article 2: Procedures 133 <br /> Section 2.2:Applications <br /> 2:22.2.7 Application Completeness <br /> (A) An application shall be considered complete and ready for processing only if it is <br /> submitted in the required form and quantity, includes all required information, and is <br /> accompanied by the required filing fee. <br /> (B) The Planning Director shall review all submitted applications to determine compliance <br /> with all submittal requirements. <br /> (C) The Planning Director shall accept or reject an application within five business days from <br /> the date of submittal. If the application is not acted upon within this time frame, the <br /> applicant shall receive a full refund of all filing fees if the application is rejected. <br /> (D) The Planning Director shall notify the applicant, in writing, of any deficiencies in the <br /> application and invite the applicant to revise the application to correct identified <br /> deficiencies. If or when the application complies with all submittal requirements, the <br /> Planning Director shall accept the application as complete and notify the applicant of its <br /> acceptance. <br /> (E) No further processing of incomplete applications will occur until deficiencies are <br /> corrected. <br /> 2.2.72.2.8 Withdrawal of Applications <br /> (A) Submission of Request <br /> Any request for withdrawal of an application subject to a public hearing shall be submitted <br /> in writing to the Planning Director, or shall be made through a verbal request at a public <br /> hearing. <br /> (B) Prior to Notice of Public Hearing <br /> The Planning Director shall approve a request for withdrawal of an application if it has <br /> been submitted prior to public notification of the application in accordance with public <br /> notification requirements for the specific application type. <br /> (C) Subsequent to Notice of Public Hearing <br /> Withdrawal of an application subsequent to public notification of the application in <br /> accordance with public notification requirements for the specific application type shall be <br /> considered, for the purposes of this Article, a denial of the application. <br /> (D) Fees <br /> Fees shall not be refunded for withdrawn applications. <br /> 2.2.82.2.9 Effect of Denial on Subsequent Applications <br /> (A) If the Board of County Commissioners denies an application, or the application is <br /> withdrawn subsequent to notice of the public hearing thereon, no application for the same <br /> or similar amendment, affecting the same property or a portion of it, may be submitted for <br /> a period of one year. Said one year period begins on the date of denial or withdrawal, as <br /> appropriate. <br /> 2.2.92.2.10 Manner of Review <br /> Applications requiring a public hearing shall be reviewed using either a legislative process or a <br /> quasi-judicial process as follows: <br /> updated/revised Concept Plans to avoid confusion for staff, local elected officials,and the public. If an application <br /> is withdrawn from consideration after scheduling of BOCC review/advertising takes place,additional application(s) <br /> cannot be filed for a period of 1 year. <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-4 <br />
