Article 2: Procedures 11 <br /> Section 2.14: Minor Subdivisions <br /> (c) Auxiliary documents prepared in accordance with Article 7 of this <br /> Ordinance which ensure completion and/or maintenance of required <br /> improvements. Such documents may include, but not be limited to, a <br /> private road maintenance agreement; escrow agreement or vette of <br /> Gpedit by an approved iRstitu� <br /> any necessary performance guarantees <br /> for required improvements; and guarantee of installation of any required <br /> road signs; <br /> (d) A copy of the Final Plat indicating approval of the plan to control <br /> sedimentation and erosion during construction of improvements. Where <br /> an erosion and sedimentation control plan" is required, it shall comply <br /> with the provisions of Section 6.15 of this Ordinance. If an erosion and <br /> sedimentation control plan 12 is not required, the copy of the Final Plat <br /> must be signed by the Erosion Control Officer certifying that a plan <br /> waiver has been approved or the amount of land disturbance on the site <br /> is not subject to the provisions of Section 6.15 of this Ordinance; and <br /> (e) A statement describing the methods proposed to protect environmental <br /> resources identified in "An Inventory of Sites of Cultural, Historic, <br /> Recreational, Biological and Geological Significance in the <br /> Unincorporated Portions of Orange County" and/or"Inventory of the <br /> Natural Areas and Wildlife Habitats of Orange County, North Carolina". <br /> (B) Review and Action <br /> (1) The Planning Director shall determine if the plat and application conform with all <br /> applicable regulations. <br /> (2) Auxiliary documents required by Article 7 shall be submitted by the Planning <br /> Director to the County Attorney for review and recommendation. <br /> (3) The Planning Director may submit copies of the Final Plat application and <br /> accompanying material to other officials and agencies for review and comment. <br /> Other potential reviewers include, but are not limited to: <br /> (a) NC DOT, <br /> (b) Orange County Schools, <br /> (c) Orange County Land Records, <br /> (d) County Attorney, <br /> (e) Orange County Environmental Health, <br /> (f) Orange County Erosion Control, <br /> (g) Orange County Engineering, <br /> (h) Public Utility Companies, and <br /> (i) Orange County Department of Environment, Agriculture, Parks and <br /> Recreation (DEAPR). <br /> (4) Reviewers shall provide a certification to the Planning Director of the suitability, <br /> provisional suitability, or unsuitability of the proposal. Recommendations of the <br /> reviewers may be incorporated as conditions of approval of the subdivision. <br /> (5) The Planning Director shall take action on an application solely on his/her <br /> findings as to compliance with applicable regulations and conditions and shall <br /> either: <br /> (a) Approve the application; or <br /> 11 Consistent use of"erosion and sedimentation control plan"as defined in 15A NCAC 02H.1002 (Definitions). <br /> 12 Consistent use of"erosion and sedimentation control plan"as defined in 15A NCAC 02H.1002 (Definitions). <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-44 <br />
