PLEASE READ IT CAREFULLY. <br /> <br />MOLD, FUNGUS OR MICROBIAL <br />CONTAMINATION EXCLUSION <br />This endorsement modifies insurance provided under the following: <br />BUSINESS AUTO COVERAGE FORM <br />COMMERCIAL GENERAL LIABILITY COVERAGE PART <br />LIQUOR LIABILITY COVERAGE PART <br />EMPLOYEE BENEFITS LIABILITY ENDORSEMENT <br />IMPROPER SEXUAL CONDUCT AND PHYSICAL ABUSE LIABILITY COVERAGE PART <br /> <br /> <br /> <br />It is agreed that this policy does not apply to any claim, suit or cause of action for “damages” due to: <br /> <br />1. "Bodily injury," "property damage," or "personal and advertising injury" arising out of or contributed to <br />by mold, fungus or "microbial contamination"; <br /> <br />2. Any loss, cost or expense arising out of any: <br /> <br />a. Request, demand or order that any "insured" or others test for, monitor, clean up, remove, <br />contain, treat, detoxify or neutralize, or in any way respond to or assess the effects of mold, <br />fungus or "microbial contamination"; or <br /> <br />b. Claim or suit by or on behalf of a governmental agency or entity for damages because of testing <br />for, monitoring, cleaning up, removing, containing, treating, detoxifying or neutralizing, or in any <br />way responding to or assessing the effects of mold, fungus or "microbial contamination." <br />We shall have no duty or obligation to provide or pay for the investigation or defense of any <br />loss, cost, expense, claim, or suit excluded under any provision set forth above. <br /> <br />Defense and Supplementary Payments shall not apply to any loss, cost, expense, claim or suit <br />excluded under any provisions set forth above. <br /> <br />"Microbial contamination" means any contamination, either airborne or surface, which arises out <br />of or is related to the presence of mold, fungus, or spores, including, without limitation, <br />Penicillium, Aspergillus, or Stachybotrys chartarum. <br /> <br /> <br /> <br /> <br /> <br /> <br />DocuSign Envelope ID: 81A61471-345A-47F9-8A2D-36F7929A6637
