<br />4. “Electronic data” means:
<br />information, facts or programs stored as or on, created or used on, or transmitted to or from computer software,
<br />including systems and applications software, hard or floppy disks, CD-ROMs, tapes, drives, cells, data processing
<br />devices or any other media which are used with electronically controlled equipment.
<br />
<br />5. “Employee claimant” includes, but is not limited to:
<br />employees, applicants for employment, former employees, officers, former officers, directors and former directors
<br />of any insured, while acting in their capacity as employees, applicants for employment, former employees, officers
<br />or former officers, directors or former directors of the insured, as well as any derivative claim of any spouse, child,
<br />brother, sister, parent, dependent, successor, subrogee or assignee of any such employee, applicant for
<br />employment, former employee, officer, former officer, director or former director.
<br />
<br />6. “Executive officer” means:
<br />a person holding any of the officer positions created by your charter, constitution, bylaws or any other similar
<br />governing document.
<br />
<br />7. “Incidental medical services” means:
<br />a. The performance of services on your behalf by a “Medical services provider” if the following two (2)
<br />conditions are satisfied:
<br />1. You have not agreed to defend, indemnify or hold harmless the “Medical services provider”
<br />against any loss, cost, claim or cause of action arising out of or as a result of the provision of
<br />such services; and
<br />2. The “Medical services provider” has applicable Professional Liability (Errors and Omissions
<br />or Professional Negligence) coverage with limits of insurance equal to or greater than the limit
<br />of liability of this Coverage Form; or
<br />b. The hiring, supervision or retention by you of a “Medical services provider.”
<br />
<br />8. “Insured contract” means:
<br />that part of any contract or agreement pertaining to your business under which you assume the tort liability of
<br />another to pay “damages” to a third person or organization. Tort liability means a liability which would be imposed
<br />by law in the absence of any contract or agreement.
<br />
<br />9. “Loading or unloading” means the handling of property:
<br />a. After it is moved from the place where it is accepted for movement into or onto an aircraft, watercraft,
<br />“mobile equipment” or “auto”;
<br /> b. While it is in or on an aircraft, watercraft, “mobile equipment” or “auto”; or
<br />c. While it is being moved from an aircraft, watercraft, “mobile equipment” or “auto” to the place where it is
<br />finally delivered;
<br />but “loading or unloading” does not include the movement of property by means of a mechanical device, other
<br />than a hand truck, that is not attached to the aircraft, watercraft, “mobile equipment” or “auto.”
<br />
<br />10. “Medical services provider” means:
<br />an individual performing healthcare services within the scope of services for which the provider is or has been
<br />licensed, including but not limited to a dentist, nurse anesthetist, nurse midwife, nurse practitioner,
<br />paramedic/EMT, pharmacist, physician, physician assistant, psychiatrist or surgeon.
<br />
<br />11. “Mobile equipment” means any of the following types of land vehicles, including any attached machinery or
<br />equipment:
<br />a. Bulldozers, farm machinery, forklifts and other vehicles designed for use principally off public roads;
<br />b. Vehicles maintained for use solely on or next to premises you own or rent;
<br />c. Vehicles that travel on crawler treads;
<br />d. Vehicles, whether self-propelled or not, maintained primarily to provide mobility to permanently mounted:
<br />(1) Power cranes, shovels, loaders, diggers or drills; or
