<br />ANI-RRG-ISCET 05 20 Page 3 of 9 <br /> <br />SECTION 3 - OTHER PAYMENTS <br /> <br />THESE PAYMENTS WILL REDUCE THE LIMITS OF INSURANCE. <br /> <br />We will pay, with respect to any "claim", “claims” or "suit" we defend: <br /> <br />1. All expenses we incur, including but not limited to, reasonable and customary attorney fees, costs <br />and disbursements. <br /> <br />2. The cost of a bond or bonds to release attachments, but only for bond amounts within the applicable <br />limit of insurance. We do not have to apply for or furnish the bond or bonds. <br /> <br />3. All reasonable expenses incurred by an insured at our request to assist us in the investigation or <br />defense of the "claim", “claims” or "suit”, including actual loss of earnings up to $100 a day because <br />of time off from work. <br /> <br />4. All costs taxed against an insured in the "suit" but this does not include any attorney’s fees or <br />expert witness fees taxed as costs pursuant to statute. <br /> <br />5. Pre-judgment interest awarded against an insured on that part of the judgment we pay. If we make <br />an offer to pay the applicable limit of insurance, we will not pay any pre-judgment interest based on <br />that period of time after the offer. <br /> <br />6. All interest on the full amount of any judgment that accrues after entry of the judgment and before <br />we have paid, offered to pay or deposited in court the part of the judgment that is within the <br />applicable limit of insurance. <br /> <br />7. Up to $10,000 to reimburse you for wages paid to your employee who is suspended with pay during <br />the investigation or defense of the “improper sexual conduct” or “physical abuse” allegations. <br /> <br />SECTION 4 - WHO IS AN INSURED <br /> <br />1. If you are designated in the Declarations as: <br /> <br />a. A nonprofit corporation, you are an insured. Your executive officers and directors are insureds, <br />but only with respect to their duties as your executive officers and directors. <br /> <br />b. A partnership or joint venture, you are an insured. Your members, your partners and their <br />spouses are also insureds, but only with respect to the conduct of your business. <br /> <br />2. Each of the following is also an insured: <br /> <br />a. Your employees, volunteers, interns and students-in-training, but only for acts within the scope <br />of their employment, volunteer work, internship or training with you. <br /> <br />b. The legal representative of any insured who has died, but only with respect to the duties of that <br />legal representative as such. That legal representative will have all of the deceased insured’s <br />rights and duties under this policy. <br /> <br />3. Any organization you newly acquire or form, other than a partnership or joint venture over which you <br />maintain ownership or majority ownership or controlling interest, will be deemed to be an insured if <br />there is no other similar insurance available to that organization.
