This insurance does not apply to “bodily injury” arising from “improper sexual conduct” or <br />“physical abuse” to: <br />a. An employee of an insured; <br /> <br />b. The spouse, parent, brother or sister of an employee of an insured; <br /> <br />c. A “resident relative” under the age of 18 of any employee of an insured, where the “improper <br />sexual conduct” or “physical abuse” is committed or alleged to be committed by that <br />employee. <br />This exclusion shall not apply when the “bodily injury” is sustained while the claimant is also your <br />client and receiving services that you customarily provide and the “bodily injury” results from <br />those services. <br /> <br />2. This insurance does not apply to "bodily injury" arising from “improper sexual conduct” or <br />“physical abuse” for which an insured is obligated to pay “damages” by reason of the assumption <br />of liability in a contract or agreement. This exclusion does not apply to liability for “damages” that <br />an insured would have in the absence of the contract or agreement. <br /> <br />3. This insurance does not apply to “bodily injury" arising from “improper sexual conduct” or <br />“physical abuse” which is subject to any obligation of an insured pursuant to a worker’s <br />compensation, disability benefits or unemployment compensation law or any similar law. <br /> <br />4. This insurance does not apply for the benefit of any individual insured who intentionally caused <br />the "bodily injury" that is the subject of the “claim”, “claims” or “suit” or is convicted of a criminal <br />offense as a result of any “improper sexual conduct” or “physical abuse”. <br /> <br />5. This insurance does not provide any coverage for or pay any defense fees or related costs arising <br />from a criminal action or proceeding. <br /> <br />6. This insurance does not apply to "bodily injury" arising from “improper sexual conduct” or <br />“physical abuse” which takes place prior to or after the effective dates of this policy. <br /> <br />7. This insurance does not apply to any “claim”, “claims” or “suit” of “sexual harassment” arising out <br />of the employment status of the claimant. <br /> <br />8. This insurance does not apply to any “claim”, “claims” or “suit” of “sexual harassment” arising out <br />of the volunteer status of the claimant. <br /> <br />9. This insurance does not apply to any “claim”, “claims” or “suit” of “sexual harassment” arising out <br />of the business invitee status of the claimant. <br /> <br />10. This insurance does not apply to any “claim”, “claims” or “suit” for “bodily injury” arising from <br />“improper sexual conduct” or “physical abuse” resulting from an act, error or omission committed <br />in the performance of professional services, except for an insured’s failure to provide professional <br />services to any person or the neglect of the therapeutic needs of any person because of <br />“improper sexual conduct” or “physical abuse” following any form of “improper sexual conduct” or <br />“physical abuse” for which an insured could be legally liable. <br />DocuSign Envelope ID: 81A61471-345A-47F9-8A2D-36F7929A6637
