<br />ANI-RRG-ISCET 05 20 Page 1 of 9 <br /> <br /> <br /> <br />IMPROPER SEXUAL CONDUCT AND PHYSICAL ABUSE <br />LIABILITY COVERAGE FORM <br /> <br />PLEASE READ THE ENTIRE FORM CAREFULLY <br /> <br />Various provisions in this policy restrict coverage. Read the entire policy carefully to determine rights, duties <br />and what is and is not covered. <br /> <br />Throughout this policy the words "you" and "your" refer to the Named Insured shown in the Declarations. <br />The words "we”, "us" and "our" refer to the Company issuing this policy. <br /> <br />The word "insured" means any person or organization qualifying as such under SECTION 4 - WHO IS AN <br />INSURED. <br /> <br />Other words and phrases that appear in quotation marks have special meaning. Refer to SECTION 7- <br />DEFINITIONS. <br /> <br />SECTION 1 - COVERAGES <br /> <br />BODILY INJURY ARISING FROM IMPROPER SEXUAL CONDUCT OR PHYSICAL ABUSE <br /> <br />1. Insuring Agreement. <br /> <br />a. We will pay those sums that an insured becomes legally obligated to pay as “damages” because <br />of "bodily injury" arising from "improper sexual conduct” or “physical abuse”. No other obligation <br />or liability to pay sums or perform acts or services is covered unless explicitly provided for under <br />SECTION 3 - OTHER PAYMENTS. SECTION 5 - LIMITS OF INSURANCE includes sums paid <br />for “damages” and OTHER PAYMENTS. The first act of “improper sexual conduct” or “physical <br />abuse” must be committed in the "coverage territory" during the effective dates of this policy’s <br />period. We will have the right and duty to defend any "suit" seeking such “damages”. But: <br /> <br />(1) The amount we will pay for “damages” and SECTION 3 - OTHER PAYMENTS is limited as <br />described in SECTION 5 - LIMITS OF INSURANCE; <br /> <br />(2) We may, at our discretion, investigate and settle any "claim", “claims” or "suit" seeking such <br />“damages”; and <br /> <br />(3) Our right and duty to defend ends when we have exhausted the applicable limits as described in <br />SECTION 5 – LIMITS OF INSURANCE or of items explicitly provided for under SECTION 3 - <br />OTHER PAYMENTS. <br /> <br />b. Any “claim”, "claims" or "suits" for “damages” because of "bodily injury" arising from a single act <br />or a series of continuous or repeated acts of "improper sexual conduct” or “physical abuse” by <br />the same person or two or more persons acting in concert, including “damages” claimed by any <br />person or organization for care, loss of services, or death resulting at any time from "bodily <br />injury" arising from “improper sexual conduct” or “physical abuse”, will be considered as having <br />resulted from the same “improper sexual conduct” or “physical abuse”, which shall be deemed to <br />have been committed on the date of the first such act.
