1 <br /> <br />North Carolina <br /> <br />Orange County <br /> <br /> <br />INTERLOCAL AGREEMENT BETWEEN ORANGE COUNTY AND TOWN OF <br />HILLSBOROUGH FOR THE FIRE PREVENTION SERVICES OF PLAN REVIEW, <br />PERMITTING, INSPECTIONS, AND RELATED SERVICES <br />TO BE PERFORMED BY THE <br />ORANGE COUNTY FIRE MARSHAL DIVISION OF THE <br />DEPARTMENT OF EMERGENCY SERVICES <br /> <br /> <br />This is an Interlocal Agreement, made and entered into by and between Orange County, <br />(hereinafter referred to as “County”), and the Town of Hillsborough, (hereinafter referred to as <br />“Town”), (collectively referred to as “Parties”) shall have an effective date as of the date on <br />which it is executed by County. <br /> <br />WHEREAS, this Agreement is entered into pursuant to North Carolina General Statutes <br />§§ 160d-202 and 1102, which permits the Town to request the Board of County Commissioners <br />to direct one or more County fire inspectors to conduct fire prevention services within the Town’s <br />jurisdiction. <br /> <br />WHEREAS, County maintains the Department of Emergency Services which includes a <br />Fire Marshal Division that conducts fire prevention services, including inspections, plan review and <br />inspections, issues permits, enforces the fire codes, authorizes facilities and capital <br />improvements, retains administrative records and provides other support services relating to the <br />Building Division operations (hardware and software) for the County, and <br /> <br />WHEREAS, the Town desires to procure the services of the County’s Emergency <br />Services’ Fire Marshal Division to perform fire protection services for plan examinations, <br />permitting and inspection services within the municipal and extraterritorial jurisdictional (ETJ) <br />boundaries of the Town, as it exists now and as it may change from time to time; and <br /> <br />WHEREAS, County, through said Fire Marshal Division, is willing to perform such <br />services pursuant to the terms and conditions hereafter set forth. <br /> <br />NOW, THEREFORE, FOR AND IN CONSIDERATION of the mutual terms, conditions, <br />promises, covenants, and payments hereinafter set forth, County and Town agree as follows: <br /> <br />ARTICLE 1 – SCOPE OF SERVICES <br /> <br />1.1.
