55 <br /> (a) The Contractor warrants that no person or agency has been employed or retained to solicit or obtain this <br /> contract upon an agreement or understanding for a contingent fee, except a bona fide employee or agency. For breach <br /> or violation of this warranty, the Government shall have the right to annul this contract without liability or, in its discretion, <br /> to deduct from the contract price or consideration, or otherwise recover the full amount of the contingent fee. <br /> (b) Bona fide agency, as used in this clause, means an established commercial or selling agency (including <br /> licensed real estate agents or brokers), maintained by a Contractor for the purpose of securing business, that neither <br /> exerts nor proposes to exert improper influence to solicit or obtain Government contracts nor holds itself out as being <br /> able to obtain any Government contract or contracts through improper influence. <br /> (1) Bona fide employee, as used in this clause, means a person, employed by a Contractor and <br /> subject to the Contractor's supervision and control as to time, place, and manner of performance, who neither exerts nor <br /> proposes to exert improper influence to solicit or obtain Government contracts nor holds out as being able to obtain any <br /> Government contract or contracts through improper influence. <br /> (2) Contingent fee, as used in this clause, means any commission, percentage, brokerage, or other <br /> fee that is contingent upon the success that a person or concern has in securing a Government contract. <br /> (3) Improper influence, as used in this clause, means any influence that induces or tends to induce a <br /> Government employee or officer to give consideration or to act regarding a Government contract on any basis other than <br /> the merits of the matter. <br /> 25. 52.203-7 ANTI-KICKBACK PROCEDURES (JUN 2020) <br /> (Applicable to leases over the Simplified Lease Acquisition Threshold.) <br /> This clause is incorporated by reference. <br /> 26. 52.223-6 DRUG-FREE WORKPLACE (MAY 2001) <br /> (Applicable to leases over the Simplified Lease Acquisition Threshold, as well as to leases of any <br /> value awarded to an individual.) <br /> This clause is incorporated by reference. <br /> 27. 52.203-14 DISPLAY OF HOTLINE POSTER(S) (JUN 2020) <br /> (Applicable to leases over $5.5 Million total contract value and performance period is 120 days <br /> or more.) <br /> (a) Definition. <br /> United States, as used in this clause, means the 50 States, the District of Columbia, and outlying areas. <br /> (b) Display of fraud hotline poster(s). Except as provided in paragraph (c)— <br /> (1) During contract performance in the United States, the Contractor shall prominently display in common work <br /> areas within business segments performing work under this contract and at contract work sites- <br /> (i)Any agency fraud hotline poster or Department of Homeland Security (DHS)fraud hotline poster identified <br /> in paragraph (b)(3)of this clause; and <br /> (ii)Any DHS fraud hotline poster subsequently identified by the Contracting Officer. <br /> (2)Additionally, if the Contractor maintains a company website as a method of providing information to <br /> employees, the Contractor shall display an electronic version of the poster(s)at the website. <br /> (3)Any required posters may be obtained as follows: <br /> LESSOR: GOVERNMENT: GSA FORM 35178 <br /> REV(10120) <br /> Page 11 <br />
