Where asphalt pavement is cut, the entire area to be repaired shall be primed with an <br /> asphalt prime coat, acceptable to the Department of Transportation, before the pavement <br /> is replaced. <br /> I. When required, the Contractor shall furnish to the Department of Transportation a 100% <br /> Performance Bond for the amount of paving to be cut and replaced along highways. <br /> Bond is required in North Carolina. <br /> J. Unless otherwise indicated, no excavated material shall be placed on the pavement side <br /> of the ditch, along State highways. The least possible amount of ditch will be left open <br /> when work is not in progress and equipment shall be removed from the pavement and <br /> shoulders during shut-down periods. <br /> K. Shoulders of roadways shall be left in good, acceptable condition and all topsoil and <br /> grass that is disturbed shall be replaced. Grassing shall include seeding, fertilizing, and <br /> mulching to conform with Department of Transportation requirements. <br /> L. The Contractor shall pay the cost of all Department of Transportation inspector's time, if <br /> required on the job. <br /> M. WORK ON RAILROAD RIGHT-OF-WAY: <br /> A. The Contractor shall not begin work on any property of the railroad until he has secured <br /> necessary permits. He shall conform to all requirements of the railroad, or its authorized <br /> representatives, in the prosecution of this portion of the work, including but not limited to <br /> the following: <br /> 1. Where a pipeline crosses under a railroad, the work shall be done in accordance <br /> with requirements of the Railway Company. Pipe shall be installed by boring and <br /> jacking (or open cut as designated). Excavation shall be done ahead of the pipe. <br /> The encasement must be kept on accurate line and slightly below grade. A <br /> tolerance of 0.5% will be allowed on short lines in good soil and not over 1% in <br /> any case. <br /> B. The Contractor shall furnish the Railway Company the following: <br /> 1. Certificate of Workers' Compensation or Employer's Liability Insurance according <br /> to the laws of the State. <br /> 2. Certificate of the Contractor's Public Liability Insurance, to protect the contractor <br /> and subcontractor for loss of life or injury to persons in an amount not less than <br /> $1,000,000 for any one person and not less than $1,000,000 for any accident, <br /> and for property loss or damage in an amount not less than $1,000,000 for any <br /> one accident and not less than $1,000,000 aggregate or as required by the <br /> Railroad Company. <br /> 3. The original policy of Railroad Protective Liability Insurance naming the Railway <br /> Company as the insured for loss of life or injury to persons in an amount not less <br /> than $2,000,000 for one person, and not less than $2,000,000 for any accident <br /> and for property loss or damage in an amount not less than $2,000,000 for any <br /> one accident and not less than $2,000,000 aggregate or as required by the <br /> Railroad Company.
