343 <br /> Current Public Notice Provisions in the UDO <br /> This information has been compiled to help inform discussions regarding notice requirements. <br /> Orar depicts steps Orange County takes above and beyond the minimum requirements of State <br /> Statutes. Red text shows the text staff is suggesting be revised to conform to State statutes. It should <br /> be noted that this does not mean that current practice will also change, only that the County's <br /> regulations would conform to statutes. <br /> Comprehensive Plan Future Land Use Map (2.3.5) <br /> • Mailed notice to all property owners within 1,000 feet at least 15 days but not more <br /> than 25 days prior to the date of the Planning Board meeting. (15 is proposed to <br /> become 10) <br /> • Sign posted at least 10 days but not more than 25 days prior to the Planning Board <br /> meeting. <br /> • Mailed notice to all property owners within 1,000 feet at least 15 days but not more <br /> than 25 days prior to the date of the public hearing. (15 is proposed to become 10) <br /> • Sign posted at least 10 days but not more than 25 days prior to the public hearing. <br /> • Legal Ad published in newspaper once a week for two consecutive weeks at least 10 <br /> days but not more than 25 days prior to public hearing. Orange County publishes in two <br /> (the News of Orange and Durham Herald Sun), this practice is not written in the <br /> LIDO but is long-standing practice; this is an example of a practice that is followed but <br /> not written into the regulations. <br /> Special Use Permits (2.7.5 and 2.7.6) <br /> • Neighborhood Information Meeting (NIM). Notices mailed to all property owners within <br /> 1,000 feet at least 14 days prior to NIM. Sign posted at least 10 days prior to NIM. (The <br /> NIM is held at least 45 days prior to the evidentiary hearing to give people time to <br /> prepare if they choose to). <br /> • Mailed notice to all property owners within 1,000 feet at least 10 days but not more <br /> than 25 days prior to the date of the evidentiary hearing. <br /> • Sign posted at least 10 days but not more than 25 days prior to the hearing. <br /> • A legal ad is currently published; the proposed 160D revisions suggest that publication <br /> of legal ads for Special Use Permits cease for reasons staff has outlined in presentations <br /> regarding quasi-judicial decisions and standing of parties to participate. <br /> Zoning Atlas [Conventional Districtsl (2.8.7) <br /> • Mailed notice to all property owners within 1,000 feet at least 1r- more <br /> than 2S days prior to the date of the Planning Board meeting.
