Article 5: Uses 202 <br /> Section 5.10: Standards for Telecommunication Facilities <br /> On existing Facilities without increasin eight of the <br /> er or structure. <br /> C. On Coun wned pro s or facilities. <br /> d. On properties ' r zoned for commercial or industrial <br /> use. <br /> e. n properties in areas zoned Agric I Residential <br /> (AR). <br /> f. On properties in areas zoned for residential use. <br /> (ii) If an Applicant proposes to place telecommunications equipment <br /> at a location that is not a preferred priority 1 site, then the <br /> Applicant must provide a detailed explanation as to why a higher <br /> priority site is not proposed. The explanation shall be in the form <br /> of a written report demonstrating the Applicant's review of the <br /> above locations in order of priority and the reason(s)for the site <br /> selection. The explanation shall, at a minimum, include the <br /> information required by section 5.10.8(13)(3)(ed). <br /> 'ii) The application shall not be approved unless it demonstrate <br /> that the telecommunications equipment may not be sited a a <br /> higher priority site because of commercial impracticabilit or <br /> because no higher priority site is available that would s rve to <br /> rovide the telecommunications service need identifi by the <br /> A licant as provided for in section 5.10.8(A)(1)(s). <br /> (iv) An A plicant may not by-pass sites of higher pri ity merely <br /> becau the site proposed is the only site leas d or selected. <br /> Agreem is between providers limiting or pr ibiting collocation <br /> shall not b a valid basis for any claim of c mmercial <br /> impracticabi ' <br /> (v) Notwithstandin that a potential site y be situated in an area <br /> of highest priority r highest availab priority, an application <br /> shall not be approv d if it conflicts ith the provisions and <br /> requirements of this dinance. <br /> (vi) Wireless support structu s s all not be located within one-half <br /> ('/2) mile of any existing m Opole, lattice or guyed wireless <br /> telecommunications sup p r tructure. <br /> a. An exception ay be a owed when the applicant can <br /> sufficiently d monstrate at: <br /> i. A propriate space the existing <br /> elecommunication wi less support structure is <br /> not available; or <br /> ii. The applicant has made g d faith effort to <br /> negotiate an agreement with he owner of the <br /> existing wireless telecommuni tion support <br /> structure and has been unsucce sful, which <br /> must be documented in writing; or <br /> iii. The telecommunication equipment o the <br /> existing wireless telecommunication su ort <br /> structure is not compatible with the prop o ed <br /> telecommunication equipment of the applic t; <br /> or <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-89 <br />
