Article 1: Administration 14 <br /> Section 1.5: Planning Department <br /> XConditions <br /> rting any variances or interpretations of the location of the boundary of <br /> of special flood hazard area to the Federal Insurance Administration on <br /> est; and <br /> ting Zoning Compliance Permits, making inspections of buildin or <br /> ises, revoking permits, and any other procedures necessar o carry out the <br /> cement of this Ordinance. <br /> 1ority <br /> When rendering decisio on the approval of development projects, a interpretation of this <br /> Ordinance, or the issuanc f permits, the Planning Director shal etermine if the application is <br /> consistent with the requireme s of this Ordinance and issue a appropriate permits or other <br /> approvals. The following limitati s apply: <br /> (A) Issuance of a permit aut izing the excav on, construction, moving, alteration, or <br /> use of land shall in no case construe s waiving any provision of this Ordinance. <br /> (B) Under no circumstances is the n ' g Director permitted to grant exceptions to the <br /> actual meaning of any clause, st rd, or regulation contained in this Ordinance to <br /> any person making application exca te, construct, move, alter, or use either <br /> building, structures or land. <br /> (C) Under no circumstance s the Planning Direc permitted to make changes to this <br /> Ordinance or to vary e terms of this Ordinance carrying out assigned duties. <br /> (D) The Planning Di ctor shall issue a permit when an a licant demonstrates that the <br /> standards est fished by this Ordinance are complied wi regardless of whether the <br /> use of the rmit would violate contractual or other arrange nts (including, but not <br /> by way imitation, restrictive covenants) among private pa <br /> (E) The anning Director shall revoke a zoning compliance permit if it found to be <br /> is ed in violation of any of the provisions of this Ordinance, or if the c ditions as <br /> tated on the permit are not carried out. <br /> (F If an application for a permit is disapproved, the Planning Director shall state i <br /> writing the cause for such disapproval. <br /> (G) The Planning Director shall issue a Stop Work Order pursuant to Article 9 of this <br /> Ordinance if it is determined that irreparable injury will occur if an alleged violation is <br /> not terminated immediately. <br /> 1.4.3 Conflicts of Interest'—' <br /> Neither the Planning Director, nor any County staff member, shall make a final decision on an <br /> administrative decision pursuant to this Ordinance if the outcome of the decision would have a <br /> direct, substantial, and readily identified financial impact on the Planning Director, or staff <br /> member, or if the applicant or other person subject to that decision is a person with whom the <br /> Planning Director, or staff member, has a close familial, business, or other associational <br /> relationship. <br /> SECTION <br /> 1.5.1 Duties and Responsibilities <br /> The Planning Department is an administrative department of the County Government headed by <br /> the Planning Director. The Planning Department shall have, under the authority of the Planning <br /> Director, the following responsibilities in relation to this Ordinance: <br /> (A) The administration and enforcement of the Ordinance. <br /> 11 Adoption of conflict of interest standards are now required, pursuant to NCGS 160D-109. <br /> Orange County, North Carolina—Unified Development Ordinance Page 1-11 <br />
