During the typical <br /> course of project work, design criteria evolve, new requirements are discovered, and <br /> unforeseeable issues arise. <br /> Basis of Agreement: <br /> Acknowledging the above, Engineer and Client agree that the fee estimates listed herein <br /> are based on the specific criteria, understandings, and assumptions listed below, even <br /> though some of these items may ultimately prove to be incorrect or inadequate to meet <br /> project needs. Where significant deviations occur, Additional Services and/or time <br /> extensions may be necessary. <br /> Construction Observation <br /> • The work to be performed for the Client consists of non-intrusive visual <br /> observations to survey the readily accessible, easily visible material components, <br /> systems and equipment of the project. <br /> • Observation services are designed to identify work performed, weather conditions, <br /> equipment used on site, construction crew involved, and issues faced during <br /> construction. <br /> • The work product resulting from completing an observation in accordance with this <br /> contract is a construction observation report. The report incorporates the <br /> information obtained during the observation. <br /> • The construction observation report shall be considered the final and exclusive <br /> findings of the observer regarding the work performed. <br /> • Testing, measuring, or preparing calculations for any system or component to <br /> determine adequacy, capacity, or compliance with any standard is outside the <br /> scope of this contract. <br /> • Observer is an expert generalist and not acting as an expert in any SPECIFIC <br /> craft or trade. <br /> • No observation can wholly eliminate the uncertainty regarding the presence of <br /> physical deficiencies and the performance of the project. <br /> • Preparation of a construction observation report in accordance with this contract is <br /> intended to reduce, but not eliminate, the uncertainty regarding the potential for <br /> component or system failure and to reduce the potential that such component or <br /> system may not be initially observed. <br /> • Client recognizes the inherent subjective nature of the observer's opinions as to <br /> issues such as workmanship, quality of original installation, and estimating the <br /> 2 <br />
