DocuSign Envelope ID:78B556CA-0O28-4315-8EF4-948059C1C6F0 <br /> 31 <br /> 13.15 If the Contractor believes that the progress of the Work has been adversely affected by <br /> adverse weather recognized by the Designer during a particular month, the Contractor shall <br /> submit a written request for extension of time to the Designer. Such a request for time extension <br /> of the Contract Time shall be submitted by the tenth (10th) day of the month following that <br /> month in which the adverse weather is encountered. The request shall include, but is not limited <br /> to, the following information: a) Detailed description of weather's effect on scheduled activities <br /> and its net effect on the critical path of the Project, and b)Weather records from the official <br /> weather station nearest the Project site and records of actual observation as contained in daily <br /> reports, correspondence, or other documentation. <br /> 13.16 This section is removed and purposefully blank. <br /> 13.17 The Contractor shall not be entitled to any adjustment in the Contract Price or other <br /> compensation from the Owner for any delay in the completion of or progress on the Work that is <br /> caused by a force majeure condition or is otherwise not caused by the sole and direct act or <br /> omission of the Owner and the Owner's employees or agents. <br /> ARTICLE 14. CHANGES IN THE WORK <br /> 14.1 Without invalidating the Contract Documents, the Owner may, at any time, or from time to <br /> time order additions, deletions, or revisions in the Work. Said additions, deletions, or revisions <br /> shall be authorized only by written Change Orders, Construction Change Directives or Field <br /> Orders. Upon receipt of a Change Order, Construction Change Directive or Field Order, the <br /> Contractor shall proceed with the Work involved. All such Work shall be executed under the <br /> applicable conditions of the Contract Documents. If any change causes an increase or decrease <br /> in the Contract Price or an extension or shortening of the Contract Time, adjustments shall be <br /> made as provided in Article 14 or Article 15. In order to expedite the Work and avoid or <br /> minimize delay in the Work that might affect the Contract Price or Contract Time, the Designer <br /> may issue a Change Order in the form of a Construction Change Directive which when signed <br /> by the Owner and Designer, directs the Contractor to proceed promptly with the Work involved. <br /> Any claim for an adjustment in Contract Price or Time, if not defined in the Construction Change <br /> Directive, shall be promptly made in writing in accordance with the procedures defined in Article <br /> 15.2. <br /> 14.2 The Designer may authorize minor changes or alterations in the Work not involving change <br /> in the Contract Price or in the Contract Time and not inconsistent with the overall intent of the <br /> Contract Documents. These may be accomplished by a Field Order. Such alterations shall not <br /> invalidate the Contract Documents nor release the surety. If the Contractor believes that any <br /> minor change or alteration authorized by the Designer entitles him to an increase in the Contract <br /> Price or an extension of Contract Time, he may make a claim therefore as provided in Article 14 <br /> or Article 15. <br /> 14.3 Except in an emergency endangering life or property, no change shall be made by the <br /> Contractor except upon prior written Change Order, Directive or Field Order authorizing such <br /> Change. <br /> 14.4 Increases in the Contract Price or extensions of the Contract Time for additional Work <br /> performed by the Contractor shall only be in accordance with a written Change Order signed by <br /> Revised NETPLANNER v2 <br />
