The <br /> Contractor shall be responsible for and pay for any such claims against the Owner. <br /> 7.16 The Contractor shall protect all landscaping designated to remain in the vicinity of the <br /> operations and barricade all walks, roads, and areas as necessary to keep the public away from <br /> the construction. <br /> 7.17 The Contractor shall provide cover and protect all portions of the Work and provide all <br /> materials necessary to protect the Work whether performed by the Contractor or any of the <br /> Subcontractors or sub-subcontractors. Any Work damaged through the lack of proper <br /> protection, or from any other cause, shall be repaired or replaced without extra cost to the <br /> Owner or extension to the Contract Time. <br /> The Contractor shall maintain the Work during construction and until the Work is accepted. <br /> This maintenance shall constitute continuous and effective effort prosecuted day by day, with <br /> adequate equipment and forces so that the Work is maintained in satisfactory condition at all <br /> times. All costs of maintenance shall be included in the Contract Price and the Contractor will <br /> not be paid an additional amount for such effort. Should the Owner or Designer observe that the <br /> Contractor at any time has failed to maintain the Work as provided herein, the Designer may <br /> immediately notify the Contractor of such noncompliance. Such notification shall specify a <br /> reasonable time within which the Contractor shall be required to remedy such unsatisfactory <br /> maintenance condition. Should the Contractor fail to properly respond to the Designer's <br /> notification, the Owner may, at the Contractor's expense, take such action as it may deem <br /> appropriate to remedy the defective maintenance, including suspension of the Contractor's <br /> Work or any part thereof. Any such expense incurred by the Owner shall be deducted from <br /> monies due or to become due the Contractor. <br /> Parking lots, streets, and walks connecting to the Project area shall be protected by the <br /> Contractor from deposits of mud, sand, stone, litter, or debris in any form. Pedestrian traffic <br /> areas around the construction limits must be maintained in a clean and safe condition at all <br /> times with required barricades and covered walkways. When excavation or other operations <br /> outside the Project limits is required, the Contractor shall, immediately following that work, <br /> return the area to its original condition. <br /> All catch basins and storm drain lines in the vicinity of the Project site shall be protected at <br /> all times from entry of dirt, rubble and other debris. The residue from the cleaning of trucks, <br /> wheelbarrows, concrete buggies, etc. must be prevented from entering the drainage <br /> system, and if cleaning is done, the residue must be contained and removed from the <br /> Project site with other refuse. <br /> 7.18 No burning of refuse or debris shall be allowed inside or around the Project during the <br /> course of construction without written authority from authorities having jurisdiction and the <br /> Owner. <br /> 7.19 The Contractor shall provide for and maintain necessary safety measures and safety <br /> programs for the protection of all persons involved with the Work. Such measures and programs <br /> shall include the requirements of the most current edition of the CAGC Safety and Health <br /> Manual [or the AGC Accident Prevention Manual in Construction], or equivalent requirements, <br /> and shall fully comply with all Federal, State, and local laws, rules, regulations, and building <br /> Revised NETPLANNER v2 <br />
