39 <br /> 1 John Roberts said yes, there will need to be unanimous agreement between all of the <br /> 2 jurisdictions. <br /> 3 Commissioner Dorosin asked if the parties cannot come to agreement, could the County <br /> 4 request that its share be bought out by the other parties. <br /> 5 John Roberts said that is an option, as well as a judicial partition of the tract. <br /> 6 Commissioner Dorosin asked if the property is in the Chapel Hill extraterritorial <br /> 7 jurisdiction (ETJ). <br /> 8 Craig Benedict said yes. <br /> 9 Commissioner Dorosin said ultimately Chapel Hill controls the review process for any <br /> 10 developments. <br /> 11 John Roberts said yes. He said there is the possibility that it could be withdrawn from <br /> 12 the ETJ, but that would be an extreme situation, and take about 2 years. <br /> 13 Commissioner Dorosin said he is concerned that development of the Greene Tract will <br /> 14 continue to be delayed, and that the County has a more expansive vision of affordable housing <br /> 15 than other jurisdictions. <br /> 16 Chair Price said the pandemic interrupted public engagement with the community on the <br /> 17 property. <br /> 18 Commissioner Dorosin said he appreciates the work the group has done, but he would <br /> 19 prefer a tighter timeline than 18 months. <br /> 20 Chair Price said the timeline could be tightened. <br /> 21 Commissioner Hamilton asked if clarification could be provided of what a judicial <br /> 22 partition means. <br /> 23 John Roberts said it would require going to the court system to divide the property. <br /> 24 Commissioner Hamilton said she supports the agreement and it does show progress. <br /> 25 She said the current board has intent and vision for the property, but the property being vacant <br /> 26 is supporting environmental goals. She said there are some benefits to leaving it undeveloped. <br /> 27 She encouraged the Board to focus on the present, and move forward to the benefit of the <br /> 28 community, the environment and economic development. <br /> 29 <br /> 30 A motion was made by Commissioner Fowler, seconded by Commissioner Hamilton, to <br /> 31 approve the interlocal agreement with the change as approved by the Town of Carrboro and <br /> 32 authorized the Chair to sign. <br /> 33 <br /> 34 Commissioner Dorosin clarified that he does not want to short circuit the process, or not <br /> 35 have public input, but the tract has been in discussion for 20 years, and there is already <br /> 36 opposition to any development.
