38 <br /> 1 Requiring that the parties act jointly in selecting professional services, entering <br /> 2 development agreements, engaging in public outreach, receiving public input, assigning <br /> 3 the Mayors, Chair, and Managers to form a working group to negotiate ultimate uses of <br /> 4 the Greene Tract before submitting their recommendations to the governing boards of <br /> 5 the parties, and reaching final determinations of the ultimate uses of the property within <br /> 6 18 months of execution of the Agreement; <br /> 7 Agreeing that the initial intent of the parties is for the property to include mixed use and <br /> 8 affordable housing, a school site with a public recreation component, a joint preserve <br /> 9 area, and connectivity (pedestrian, vehicular, utility, transportation); <br /> 10 Providing a dispute resolution process that requires good faith participation by the <br /> 11 parties and includes initial negotiation by the working group followed by mediation if <br /> 12 necessary; <br /> 13 Providing a means by which the parties may partition their ownership interests and <br /> 14 dispose of the property if agreement cannot be reached on the ultimate uses of the <br /> 15 property. <br /> 16 <br /> 17 The Interlocal Agreement is planned for adoption consideration at the April 6, 2021 Carrboro <br /> 18 Town Council meeting and the April 7, 2021 Chapel Hill Town Council meeting. Any <br /> 19 amendments to the Interlocal Agreement by the Town of Chapel Hill or the Town of Carrboro <br /> 20 would prompt a return to the BOCC for consideration. <br /> 21 <br /> 22 Greene Tract Update <br /> 23 Additional information on the Greene Tract, including next steps following the adoption of the <br /> 24 Interlocal Agreement, is contained in Attachment 3. Staff will not present the update at the <br /> 25 BOCC meeting, but will be available to address any questions. <br /> 26 <br /> 27 John Roberts reviewed the background information, and the terms of the interlocal <br /> 28 agreement. He said the Town of Carrboro approved the interlocal agreement with the following <br /> 29 change: deleted last sentence in mediation paragraph (page 8) and replaced with "an <br /> 30 agreement will be binding contingent upon approval by each of the governing bodies." <br /> 31 Commissioner Greene clarified that in 2g, the words "final approval" means after a lot of <br /> 32 discussion by all of the boards. <br /> 33 John Roberts said yes. <br /> 34 Commissioner Fowler asked if there could be clarification about connecting natural <br /> 35 areas. <br /> 36 Craig Benedict, Planning Director, said the County's property will be reshaped to create <br /> 37 connections to 24 acres of preserved property. He said the County's share of that preserved <br /> 38 area is 60 acres. <br /> 39 Commissioner Fowler asked if further clarification could be provided. <br /> 40 Craig Benedict said there will be a total of 82-84 acres of preservation. He said there <br /> 41 are 164 acres total, with 104 that are jointly owned and 60 acres of County owned. He said the <br /> 42 County's 60 acres may be reshaped to take the best environmental lands. He said some of the <br /> 43 original 60 acres may be developed, while other better parts of environmental lands will be <br /> 44 added to create a newly shaped 60 acres. <br /> 45 Commissioner Dorosin asked if clarification could be provided on the time frame for <br /> 46 future developments. <br /> 47 John Roberts said there will likely be an 18-month process in reviews, depending on <br /> 48 public engagement. <br /> 49 Commissioner Dorosin clarified that it will require unanimity between all of the <br /> 50 jurisdictions, including mediation. <br />
