31 <br /> 1 Public Notifications: In accordance with Section 2.8.7 of the UDO, notices were mailed via first <br /> 2 class mail to property owners within 1,000 ft. of the subject parcel providing the date/time of the <br /> 3 BOCC public hearing where the proposal is to be reviewed on March 18, 2021, 19 days before <br /> 4 the meeting. Staff also posted the subject parcel with a sign indicating the date/time of the <br /> 5 public hearing on March 22, 2021, 15 days before the meeting. For more information, please <br /> 6 refer to Attachment 7. <br /> 7 <br /> 8 Planning Board Recommendation: The Planning Board reviewed this request at its March 3, <br /> 9 2021 regular meeting where the following comments were made: <br /> 10 A Board member asked if another future land use designation that would be appropriate <br /> 11 for the property. There was discussion on the merits of extending the Economic <br /> 12 Development Transition Activity Node, west of the property across NC Highway 86, as <br /> 13 an alternative to CITAN. <br /> 14 STAFF COMMENT: According to the Comprehensive Plan, the GC-4 general <br /> 15 use zoning district is only permitted within the: <br /> 16 ➢ Commercial Transition Activity Node, and <br /> 17 ➢ Commercial Industrial Transition Activity Node (CITAN). <br /> 18 Based on surrounding land use designations, and the applicant's wishes, CITAN <br /> 19 was the only option. <br /> 20 Unfortunately, the area is not suitable for non-residential zoning/development <br /> 21 based on existing agreement(s) between the Town and County. Until these <br /> 22 agreement(s) are modified, neither CITAN or Economic Development Transition <br /> 23 Activity Node could be extended onto the subject property. <br /> 24 Board members acknowledged receipt of two emails from adjacent property owners <br /> 25 requesting the application be denied due to anticipated traffic impact(s) from non- <br /> 26 residential development and extension of `urban development intensities' into what they <br /> 27 perceived to be a `rural' area of the county. <br /> 28 The applicant did not speak at the Planning Board meeting. <br /> 29 After discussing the request, and reviewing staff's recommendation, Board members voted <br /> 30 unanimously to recommend denial of the Statement of Consistency (Attachment 8) and the <br /> 31 proposed Zoning Atlas Amendment (Attachment 9). The requested rezoning (i.e. R-1 to GC-4) cannot be approved without the extension of <br /> 42 CITAN; <br /> 43 c. The requested rezoning is inconsistent with the current policies of the adopted County <br /> 44 Comprehensive Plan, the Town of Hillsborough/Orange County Central Orange <br />
