19 <br /> Land Use Buffers/Setbacks: The Concept Plan for Orange County does not propose structures or <br /> habitable lots, so building setbacks and land use buffers do not apply. However, of the 11.24 acre lot <br /> proposed as part of the Pyewacket subdivision, the majority (82%, 9.24 acres) is proposed as <br /> Common Open Space. See the Concept Plan in Attachment 3. <br /> STAFF COMMENT.- For public water system wells, the State requires a 100' setback <br /> from the well. This setback is denoted on the Concept Plan. <br /> PROCESS, SCHEDULE, AND ACTION: The UDO requires the following process for Major <br /> Subdivision Flexible Development applications: <br /> 1. Neighborhood Information Meeting: Staff held this meeting on April 20, 2021. Please <br /> refer to Attachment 5 for meeting materials and notes. <br /> 2. Planning Board (Concept Plan): The Planning Board reviews and takes action on the <br /> Concept Plan application. This review begins on May 5, 2021. <br /> The Concept Plan review is intended to allow Board members and the applicant to <br /> discuss the proposal and identify possible solutions to any concerns with the proposed <br /> plan. If approved, the Concept Plan serves as a "roadmap" for the applicant in <br /> preparing their Preliminary Plat application submittal. <br /> 3. Planning Board (Preliminary Plat): Once a Concept Plan is approved, the applicant <br /> submits a Preliminary Plat application to Planning staff. The Planning Board reviews <br /> and makes a recommendation on the approval of the Preliminary Plat. <br /> 4. BOCC: The BOCC reviews and takes action on the Preliminary Plat application. <br /> 5. Final Plat: Once all construction is completed or appropriate bonds have been <br /> approved, staff coordinates the recordation of a Final Plat legally creating the proposed <br /> lots. <br /> PUBLIC NOTICE: UDO Section 2.15.2 requires that staff mail letters to property owners within <br /> 1,000 feet of the subject property to notify them of the Neighborhood Information and Planning <br /> Board meetings. Staff is required to post notification signs on the subject property as well. Staff <br /> mailed notices and posted the subject property as required. See Attachment 5 for meeting <br /> correspondence and staff's mailing/sign certifications. <br /> Staff held the Neighborhood Information Meeting (NIM) on April 20, 2021. Ten residents, <br /> Planning staff, and the applicant attended the meeting. See Attachment 5 for notes from the <br /> meeting. <br /> ANALYSIS: UDO Section 2.15.2 (E) requires that the Planning Director prepare and submit a <br /> recommendation on the Concept Plan to the Planning Board for consideration. The Planning <br /> Director offers the following information, analysis, and recommendation: <br /> 1. The application has been deemed complete in accordance with the requirements of UDO <br /> Sections 2.2 and 2.15.2; <br /> 2. The County is, essentially, being asked to approve development of a new public road to <br /> serve a residential development within Chatham County. Similar proposals have been <br /> reviewed and approved by the County in the past for developments within both Durham <br /> and Chatham counties; <br />
