14 <br /> 1 BACKGROUND: <br /> 2 On November 1, 2016, Orange County Sheriff Blackwood announced a new directive regarding <br /> 3 searches and formalized it by adding a section to the Sheriff's Office Policy Manual concerning <br /> 4 obtaining written consent. The Sheriff recognized that although the US Supreme Court allows <br /> 5 consent to be provided verbally, in writing, or by other means, he determined that his deputies <br /> 6 should always attempt to obtain written consent prior to conducting a search, when practicable <br /> 7 and when the safety of officers, suspects, or members of the public would not be negatively <br /> 8 impacted by doing so. The Sheriff and his staff are prepared to report on the implementation of <br /> 9 the written consent form. <br /> 10 Major Kevin Jones, Support Services, showed the form used for consent to search, and <br /> 11 provided examples of times a deputy might use the form to request consent. He said consent is <br /> 12 not required when probable cause is present. He said the Sheriff's Department has been using <br /> 13 a form since 2016.
