3 <br /> 1 NOTE - If the individuals listed above are appointed, the following vacancies remain: <br /> 2 <br /> POSITION EXPIRATION VACANCY INFORMATION <br /> DESIGNATION DATE <br /> Alternate 06/30/2022 This position has been vacant since <br /> 08/10/2020. <br /> 3 <br /> 4 Commissioner Greene asked if John Roberts could clarify his advice regarding the <br /> 5 ethics policy. <br /> 6 John Roberts said when the Board approved this policy about elected officials serving, it <br /> 7 only applied to certain advisory boards and committees. He said it was not applied to quasi- <br /> 8 judicial boards; however, certain provisions of the policy, which included the ethics portion and <br /> 9 the reporting of property owned, were applied to quasi-judicial boards. <br /> 10 Commissioner Greene asked if the planning board is a quasi-judicial board. <br /> 11 John Roberts said no. <br /> 12 Commissioner Dorosin said his intent in bringing up the policy, was not to distinguish <br /> 13 between boards, but rather his intention was to not appoint any elected officials to any boards. <br /> 14 He said, since Samantha Cabe's term has expired, he does not think she should be <br /> 15 reappointed. <br /> 16 Commissioner McKee asked if Samantha Cabe is eligible for a second term. <br /> 17 Chair Price said Samantha Cabe is eligible, but she was under the same impression as <br /> 18 Commissioner Dorosin, that the BOCC would not appoint elected officials to any board. <br /> 19 Commissioner Dorosin said she has already served an additional year and a half to two <br /> 20 years. <br /> 21 Commissioner McKee said he does not support not reappointing her, unless there was a <br /> 22 reason other than the Board changed its policy. <br /> 23 Commissioner Dorosin said Cabe has been serving past the end date of her first term. <br /> 24 Commissioner Greene said her first term has ended, and this is not the middle of her <br /> 25 second term. She said no one is guaranteed a second term, and a change in policy is a reason <br /> 26 not to reappoint. <br /> 27 Commissioner McKee acknowledged that a second term is not a guarantee, but said <br /> 28 there is a reasonable assumption that a person would be reappointed to a second term unless <br /> 29 there was some other lack of performance. He said Samantha Cabe had nothing to do with the <br /> 30 Board's change in policy, and he supports appointing her to a second term. <br /> 31 Chair Price said this situation provides an opportunity to come into compliance with a <br /> 32 rule the Board has set. She said there are no other applicants, but the County should continue <br /> 33 to look for other applicants. She agreed with Commissioner Dorosin and Commissioner <br /> 34 Greene. She said she does not know how many cases the Board of Adjustment is considering. <br /> 35 Thom Freeman-Stuart confirmed there are no other applicants for the position, and he <br /> 36 does not know if there are any cases coming before the Board of Adjustment. <br /> 37 Commissioner Dorosin said there is an alternate, and he agreed with the Chair's <br /> 38 comment that this is an opportunity to come into compliance. He said it has not been the <br /> 39 default policy of the Board to grant a second term. He said he does not support nominating <br /> 40 Samantha Cabe to the Board of Adjustment. <br /> 41 Commissioner Fowler said if there is an alternate who could take Samantha Cabe's <br /> 42 place, then she supports taking the opportunity to come into compliance. <br /> 43 Commissioner Bedford said she wondered initially if there was a conflict of interest, but <br /> 44 that concern was satisfied. She said she can support having the alternate step in, and <br /> 45 searching for a new applicant to be consistent with the Board's policy. She said said there is <br /> 46 one alternate, Leon Meyers, and the other alternate position is vacant. <br />
