22 <br /> 1 VOTE: UNANIMOUS <br /> 2 <br /> 3 PUBLIC COMMENTS: <br /> 4 Chad Abbott asked if a condition could be applied to the application, such that the owner <br /> 5 could have a separate maintenance building on the property at a location that still complies with <br /> 6 setbacks and impervious surface requirements. He said it does not change the use or the <br /> 7 conditional zoning use of the property. He said the owner has requested a 20 by 30 shed, for <br /> 8 lawn care and maintenance equipment, outside of the fenced area of the property. He asked if <br /> 9 staff could review this to make sure it meets the requirements of the zoning district. <br /> 10 John Roberts said the Board would need to determine if staff could review this condition, <br /> 11 and, if so, staff would need time to review this condition, and it would require the item be <br /> 12 continued to a future meeting. <br /> 13 Michael Harvey clarified the request by Chad Abbott, and said the building would not be <br /> 14 for a business purpose, but rather just for storage. He said he did not see this condition as a <br /> 15 problem, as there would not be any land disturbance, and it would not result in an increase in <br /> 16 impervious surface. <br /> 17 Chad Abbott said the shed would be outside of the storage facility, and outside of the <br /> 18 fenced area. He said it would not be on impervious, but the impervious calculations for the <br /> 19 watershed for the property would still be maintained. He said the stormwater group would <br /> 20 review the construction drawings to make sure they meet the maximum impervious amounts. <br /> 21 He said the condition of the storage facility would be in keeping with the zoning requirements of <br /> 22 the property. <br /> 23 Commissioner Greene asked if the condition is consistent with the zoning, why should it <br /> 24 be continued to a future meeting. <br /> 25 John Roberts said staff might need time to review it, but it seems that staff does not <br /> 26 need that additional time. <br /> 27 Craig Benedict said if the shed does not exceed the limits of 12%, then it can be <br /> 28 approved. <br /> 29 Commissioner Hamilton said she would like to have the item come back before the <br /> 30 Commissioners at a future meeting, giving staff time to review and confirm that the condition is <br /> 31 consistent with zoning. <br /> 32 Commissioner McKee said the requested condition is not inappropriate to consider at <br /> 33 the meeting, because of the nature of the facility. He said the process is set up to allow these <br /> 34 types of negotiations. <br /> 35 Michael Harvey said he does not have any concerns about adding the storage facility. <br /> 36 Commissioner Dorosin said he understands Commissioner Hamilton's point. He said if <br /> 37 the Applicant is changing the application, then it should be reviewed by staff and voted on a <br /> 38 future date. He said if the Applicant is not making a change to the application, then it does not <br /> 39 seem to be something the Board needs to consider. He said if it is not part of the project area, <br /> 40 then the Board does not even need to talk about it, nor have justification for the item to return to <br /> 41 the Board. <br /> 42 Michael Harvey said the application does not include the extra storage building, and, <br /> 43 ideally, it needs to be shown on the site plan. He said it is an accessory unit, so he would be <br /> 44 willing to support the Applicant's request that a condition be imposed. He said it is not going to <br /> 45 increase the additional storage space on the site, nor will it increase the impervious surface. <br /> 46 Commissioner Dorosin asked if the extra storage facility was added to the application <br /> 47 earlier in the process, would Michael Harvey have asked the Applicant to add it to the site plan. <br /> 48 Michael Harvey said yes. <br /> 49 Chad Abbott apologized for the late notice of this request. He shared his screen to show <br /> 50 the property. <br /> 51 Chair Price asked if this shed will be in the area that needs to be rezoned. <br />
