16 <br /> 1 <br /> 2 STAFF COMMENT: The proposed buffers are consistent with the original Conditional Zoning <br /> 3 District approval from 2012. The applicant will be required to maintain these buffers consistent <br /> 4 with Section 6.8 Landscaping, Buffers & Tree Protection. <br /> 5 Environmental Assessment (EA): Per Section 6.16.2 (A) of the LIDO, the application was <br /> 6 exempt from the Environmental Assessment (EA) requirement because the development area <br /> 7 for the project is less than two acres. <br /> 8 <br /> 9 Analysis: As required under Section 2.9.2 (E) of the UDO, the Planning Director is required to: <br /> 10 `cause an analysis to be made of the application'and pass that analysis on to the reviewing <br /> 11 body. In analyzing this request, the Planning Director offers the following: <br /> 12 1. The application is complete in accordance with the requirements of Section 2.9.2 (C) of <br /> 13 the UDO; <br /> 14 2. The proposal appears consistent with the various goals outlined within the <br /> 15 Comprehensive Plan concerning development, including: <br /> 16 a. Land Use Overarching Goal: Coordination of the amount, location, pattern, and <br /> 17 designation of future land uses, with availability of County services and facilities <br /> 18 sufficient to meet the needs of Orange County's population and economy <br /> 19 consistent with other Comprehensive Plan element goals and objectives. <br /> 20 b. Land Use Goal 2: Land uses that are appropriate to on-site environmental <br /> 21 conditions and features and that protect natural resources, cultural resources, <br /> 22 and community character. <br /> 23 c. Land Use Goal 3: A variety of land uses that are coordinated within a program <br /> 24 and pattern that limits sprawl, preserves community and rural character, <br /> 25 minimizes land use conflicts, supported by an efficient and balanced <br /> 26 transportation system. <br /> 27 d. Objective LU-3.1: Discourage urban sprawl, encourage a separation of urban <br /> 28 and rural land uses, and direct new development into areas where necessary <br /> 29 community facilities and services exist through periodic updates to the Land Use <br /> 30 Plan. <br /> 31 3. The proposed development is consistent with existing/anticipated development within <br /> 32 the area and the various land uses associated with the project are compatible with <br /> 33 various goals/policies as detailed herein; <br /> 34 4. The project is consistent with the findings and recommendations contained within the NC <br /> 35 Highway 57 Small Area Plan with respect to development in the area; <br /> 36 5. The proposed land use buffers are consistent with the 2012 approval and will adequately <br /> 37 screen the land use from NC 57, Bacon Road, and the cement mixing operation to the <br /> 38 east. <br /> 39 Neighborhood Information Meeting: A neighborhood information meeting for the project was <br /> 40 held on December 17, 2020 in accordance with Section 2.9.2 (D) of the UDO. The meeting was <br /> 41 held in an on-line format due to current public health concerns. No members of the public <br /> 42 attended the meeting. <br /> 43 <br /> 44 Public Notifications: In accordance with Section 2.8.7 of the LIDO, notices were mailed via first <br /> 45 class mail to property owners within 1,000 ft. of the subject parcel providing the date/time of the <br /> 46 BOCC public hearing where the proposal is to be reviewed. These notices were mailed on <br /> 47 January 15, 2021, 17 days before the meeting. Staff also posted the subject parcel with a sign <br /> 48 indicating the date/time of the public hearing of the rezoning request on January 15, 2021.
