Conditional Zoning District applications are reviewed in a legislative <br /> manner. A legislative review process is typically used to review requests <br /> to rezone property, act on certain applications proposing the subdivision <br /> of property, or to amend local land use regulations as contained within the <br /> Orange Count Unified Development Ordinance (UDO). It is the most <br /> common review process employed by the County. <br /> Participation in meetings is open to the public (i.e. anyone can address <br /> the elected officials or staff on a legislative item where as in a quasi- <br /> judicial process only those individuals with standing' can offer testimony <br /> and/or evidence). The Orange County Board of Commissioners can solicit <br /> and consider the comments and concerns of many different constituents <br /> and listen to the different viewpoints involved in an issue. <br /> Decisions on legislative items' are made based on all comments received, <br /> the recommendation of the County Planning Board, a recommendations <br /> made by County staff, as well as the Board members own experiences, <br /> opinions and judgment. Decisions are not based on sworn testimony or <br /> competent/material evidence (i.e. like a quasi-judicial proceeding). <br /> B. Could this process be extended by a month or so if the CFE <br /> wanted more time to study? Or can the BOCC extend a decision <br /> in order to do additional research? <br /> The BOCC can request additional input, but only the BOCC can ultimately delay action <br /> for further study. <br /> Please note per Section 2.2.2 of the UDO: The Planning Director, Planning Board, <br /> Board of Adjustment, Board of County Commissioners and all other authorized review <br /> and decision-making bodies shall make every reasonable effort to process, review, and <br /> act on applications in a timely manner, consistent with the need to fully consider the <br /> application's proposed impact and ensure that it is consistent with the spirit and intent <br /> of the Orange County Comprehensive Plan and otherwise advances the public health, <br /> safety, and general welfare. <br /> C. Where is this project in context of the water supply watershed? <br /> As shown on the watersheds map provided in the January 11 CFE packet, this proposed <br /> project is located within the Upper Eno watershed.
