Such remedies are not exclusive and are in addition to all other remedies that <br /> may be available at law, in equity or otherwise. <br /> 0) Attorneys' Fees. In the event that any action is instituted or commenced by either Party <br /> against the other Party arising out of or related to this TOS, the substantially prevailing Party is <br /> entitled to recover its reasonable attorneys'fees and court costs from the non-prevailing Party. <br /> (k) Counterparts. This TOS may be executed in counterparts, each of which shall be deemed an <br /> original, but all of which together shall be deemed to be one and the same agreement. A signed <br /> copy of this TOS delivered by facsimile, email or other means of electronic transmission, as well as <br /> photocopies of such facsimile transmission or email correspondence (e.g., DocuSign), pursuant to <br /> the Uniform Electronic Transactions Act, Mont.
