128 <br /> Article 3: Base Zoning Districts <br /> Section 3.8:Conditional Districts <br /> (D) A rezoning request to a Conditional District is a voluntary procedure that is intended for <br /> firm development proposals. <br /> 3.8.3 Districts Established <br /> (A) Conditional Zoning Districts74 <br /> (1) Conditional )Districts are floating zoning districts, permitted within <br /> most land use designations allowing for the development of specific land uses,in <br /> accordance with established standards. <br /> (2) A SZ-Conditional District requires the approval of a rezoning by the Board of <br /> County Commissioners,approval of a site plan or Master Plan,and may include <br /> agreed-upon conditions of development. <br /> (3) The following SZ-Conditional Districtsdistrists are hereby established: <br /> (a) Agricultural Support Enterprises(ASE-SZCD) <br /> (b) Agricultural Support Enterprises—Rural Buffer(ASE-RB-CD)7-5 <br /> M(c) Home Park(HP-SZCD) <br /> (e)(d) Master Plan Development(MPD-SZCD) <br /> (e) Master Plan Development—Rural Buffer(MPD-RB-CD) <br /> (f) NC Highway 57 Speedway Area Rural Economic Development Area <br /> (REDA-OZCD-1) <br /> (q) Residential(R-CD) <br /> (h) Residential—Rural Buffer(R-RB-CD) <br /> (i) Non-Residential(NR-CD) <br /> W(i) Non-Residential—Rural Buffer(NR-RB-CD) <br /> (4) Land uses permitted within OZ-Conditional Districtsdistrists shall be those uses <br /> detailed within Section 5.2 of this Ordinance. <br /> (5) Development standards feF Gh di6tFi^f aFe leGated in Article 6 of this Ordinance <br /> apply to Conditional Districts unless a condition is approved which modifies a <br /> standard.However,a condition which allows a standard less than a state or <br /> federal minimum shall not be approved.tfj <br /> — <br /> (B) Conditional 11 f <br /> �� Use <br /> 74 160D-703 of the statutes standardizes the term"conditional zoning district"to"conditional district."New <br /> conditional districts are necessary in order to provide an approval path for uses that were formerly subject to <br /> either the Conditional Use regulations or that required a Class A Special Use Permit. <br /> 75 In order to conform both state statutes and the Joint Planning Agreement,four new conditional districts that <br /> apply only to the Rural Buffer are necessary. The currently existing ASE-CZ and MPD-CZ will no longer be <br /> applicable within the Rural Buffer land use classification. Uses that are currently restricted from the Rural Buffer <br /> via language in the use-specific standards in Article 5 will not be permitted in the new conditional districts. These <br /> revisions are being proposed because of concerns raised by the County Attorney's office regarding referencing a <br /> land use classification in the use-specific standards(Art.5) and within the"district specific development <br /> standards"that are part of each chart in Article 3.(The Comprehensive Plan is advisory in nature while the <br /> standards in the UDO are regulatory). The effect of the revisions results in no change from how the Rural Buffer <br /> and Joint Planning Agreement/Joint Land Use Plan is currently administered,the primary change is in how the <br /> implementing regulations are written. <br /> 76 The existing statement is not accurate.
