Article 5: Uses 223 <br /> Section 5.14: Standards For Manufacturing,Assembly, Processing,and Distribution Uses—Food <br /> (6) Food services are not allowed unless approved in the permit or conditions of <br /> approval, as applicable. <br /> (7) The permit or conditions of approval, as applicable, may limit the frequency of <br /> events. <br /> (8) Retail sales are intended to be comprised primarily of products produced on-site <br /> but may include complementary items. <br /> 5.14.3 Winery <br /> (A) Use Standards <br /> (1) Winery Production Only and Winery with Minor Events, as defined within this <br /> Ordinance, shall be permitted as more than one principal use if located on a <br /> bona fide farm. Refer to Section 6.2.5 of this Ordinance. <br /> (2) Winery with Major Events, as defined within this Ordinance, shall: <br /> (a) Only be permitted within the ASE-CZ-CD and MPD-CZ-CD Zoning <br /> Districts. <br /> (b) Shall not be permitted within the Rural Buffer land use classification, as <br /> designated by the adopted Comprehensive Plan, as part of a Conditional <br /> 'District application. Refer to Section 5 1 3 of this Ordinance 122 <br /> (3) Specific Standards for RB and AR Zoning Districts <br /> (a) Only Winery, Production Only shall be permitted for development. <br /> (B) Submittal Requirements <br /> (1) Applications for a Winery, Production Only; Winery with Minor Events; and <br /> Winery with Major Events as defined within this Ordinance shall include a <br /> comprehensive groundwater study, for facilities expected to use more <br /> groundwater on an annual basis than an average single family residence (which <br /> uses 240 gallons of water per day) built at the highest density the existing zoning <br /> district would allow. For example, if the existing zoning district allows a residential <br /> density of 1 unit for 2 acres and the proposed use is on a six acre parcel (which <br /> could yield 3 residences), the proposed use(s) may use three times the water <br /> used by an average single family residence (or 720 gallons per day, on an <br /> annualized basis) before a comprehensive groundwater study is required. The <br /> water usage rates of any existing use subject to zoning regulations located on <br /> the same lot shall be taken into account when determining if a comprehensive <br /> groundwater study is required. Said study shall detail: <br /> (a) The amount of water anticipated to be used on a daily, weekly, monthly, <br /> and annual basis by regulated uses located on the parcel (e.g., water <br /> usage by bona fide farm uses is not required to be included); <br /> (b) An analysis of the amount of groundwater withdrawal considered to be <br /> safe and sustainable in the immediate vicinity; and <br /> (c) An analysis of whether other wells in the vicinity of the proposed use are <br /> expected to be affected by withdrawals made by the proposed use. <br /> (2) Additional Submittal Requirements for Winery with Minor Events and <br /> Winery with Major Events <br /> (a) In addition to the requirements in Sections 2.7 and/or 2.9, as applicable, <br /> the following information shall be submitted with the application <br /> materials: <br /> (i) Description of special events to be held on-site, including <br /> 1ZZ Unnecessary text. <br /> Orange County, North Carolina—Unified Development Ordinance Page 5-119 <br />
