Harvey, Planner 111, (919) 245-2597 <br /> Withdrawing Application <br /> PURPOSE: To allow the Board to formally acknowledge the withdrawal of a Master Plan <br /> Development Conditional Zoning District (MPD-CZ) application. <br /> BACKGROUND: The BOCC was scheduled to take action at its February 16, 2021 Business <br /> meeting on a Zoning Atlas Amendment, submitted by Buc-ee's Limited, rezoning two parcels <br /> within the Cheeks Township to MPD-CZ allowing for the development of Efland Station. <br /> On Friday February 5, 2021, the County received a letter from Mr. Stan Beard, the Director of <br /> Real Estate for Buc-ee's Limited (Attachment 1), formally withdrawing the application. As a <br /> result, no further action on the request is required by the County. <br /> Per Section 2.2.8 of the Unified Development Ordinance (UDO), no application: ... for the same <br /> or similar amendment, affecting the same property or a portion of it, may be submitted for a <br /> period of one year. Said one year period begins on the date of denial or withdrawal, as <br /> appropriate. While staff is able to process site plan application(s) proposing development <br /> consistent with current land use designations and regulations, submittal of a new MPD-CZ <br /> application proposing similar development (i.e. travel center with gas pumps, office, restaurant, <br /> light manufacturing, etc.) will not be possible until February 5, 2022. <br /> FINANCIAL IMPACT: There are no financial impacts associated with the Board acknowledging <br /> the request has been withdrawn by the applicant. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to <br /> this item: <br /> • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND <br /> ENVIRONMENTAL POLICIES <br /> The fair treatment and meaningful involvement of people of all races, cultures, incomes <br /> and educational levels with respect to the development and enforcement of <br /> environmental laws, regulations, policies, and decisions. Fair treatment means that no <br /> group of people should bear a disproportionate share of the negative environmental <br /> consequences resulting from industrial, governmental and commercial operations or <br /> policies. <br />
