18 <br /> 1 on an application submitted by Buc-ee's Limited to rezone two parcels with PIN numbers 9854- <br /> 2 16-1576 and 9854-36-3711 (hereafter `the Property'): <br /> 3 <br /> 4 FROM:Office/Research and Manufacturing (O/RM); Upper Eno Protected Watershed Protection <br /> 5 Overlay District; Major Transportation Corridor (MTC) Overlay District; Efland Interstate Overlay <br /> 6 District. <br /> 7 <br /> 8 TO: Master Plan Development Conditional Zoning (MPD-CZ) district; Upper Eno Protected <br /> 9 Watershed Protection Overlay District; Major Transportation Corridor (MTC) Overlay District; <br /> 10 Efland Interstate Overlay District. <br /> 11 <br /> 12 BACKGROUND: BOCC review of this item began at the BOCC's December 15, 2020 <br /> 13 Businessmeeting and concluded with the closure of the public hearing on January 12, 2021. <br /> 14 Agenda materials from the public hearing can be accessed at: <br /> 15 http://server3.co.orange.nc.us:8088/WebLink/Browse.aspx?startid=61357&row=1&dbid=0. <br /> 16 Video from the December 15, 2020 and January 5 and 12, 2021 meetings can be accessed at: <br /> 17 https://www.orangecountync.gov/967/Meeting-Videos <br /> 18 <br /> 19 As indicated at the December 15 BOCC meeting, staff recommended the imposition of several <br /> 20 conditions designed to address potential impacts of the Project, including: <br /> 21 i. Stormwater: Imposition of a condition that requires the applicant to either: <br /> 22 a. Abide by nutrient reduction strategies as detailed in Section 6.14.7 of the UDO <br /> 23 without participation in the State recognized offsite mitigation program; or <br /> 24 b. Any off-site mitigation has to occur in Orange County near the Property, within the <br /> 25 County's Upper Eno Protected or Critical Watershed Protection Overlay District, to <br /> 26 ensure preservation of local water quality. <br /> 27 ii. Access Management: <br /> 28 a. Driveway access from the Interstate on/off ramp be restricted to two driveways, one <br /> 29 allowing access to the Project east of Mt. Willing Road (i.e. a right turn only into the Project) and <br /> 30 one allowing access to the on/off ramp west of the US <br /> 31 Highway 70/1-85 Connector Road (i.e. a right turn only out of the Project); <br /> 32 <br /> 33 Staff has continued to work with the applicant and NCDOT officials to preserve <br /> 34 westbound Exit 160 as being part of a dual westbound exit for both Exit(s) 160 and 161 at the <br /> 35 existing Exit 161 location. <br /> 36 <br /> 37 Attachment 2 contains the applicant's response to several recommended condition(s), including: <br /> 38 1. Alteration of land uses: <br /> 39 a. District 1: Proposed car wash eliminated; <br /> 40 b. Development Area 5: Building square footage reduced from 150,000 to 75,000 <br /> 41 sq.ft. <br /> 42 2. Impervious area versus Open Space: <br /> 43 a. Impervious area limited to 60% or approximately 2,718,144 sq.ft. (62.4 acres) of land <br /> 44 area; <br /> 45 b. Open space increased to 40% or approximately 1,812,096 sq.ft. (41.6 acres) of land <br /> 46 area. <br /> 47 3. Setbacks: Northern boundary property line/land use buffer area increased to 50 ft. as <br /> 48 requested by staff; <br /> 49 4. Stormwater: <br /> 50 a. Install debris screens on all stormwater inlets to address comment(s) from the Eno <br /> 51 River Association; <br />
