25 <br /> 1 Section 6.8.7 (D) (1) (a) of the UDO requires parking areas to provide a- landscape area <br /> 2 at least ten feet in width, exclusive of drainage and/or utility easements, between the <br /> 3 vehicular use areas and the right of way or adjacent property line. <br /> 4 Stream buffers shall be in accordance with the provisions of Section 6.13 of the UDO and range <br /> 5 from 65 to 80 ft. based on slope; <br /> 6 Environmental Assessment (EA): The applicant completed the EA for this project as required <br /> 7 under Section 6.16 of the UDO. At this time the EA indicates: <br /> 8 i. Project will not impact any environmentally sensitive areas; <br /> 9 STAFF COMMENT: Existing water features (i.e. streams, ponds, wetlands) are <br /> 10 located within identified open space areas. Stream buffers are protected consistent <br /> 11 with Section 6.13 of the UDO. <br /> 12 ii. Steep slopes along the southeastern property line are going to be preserved in established <br /> 13 open space/Major Transportation Corridor (MTC) buffers; <br /> 14 iii. No culturally/archeologically significant areas have been denoted on the properties; <br /> 15 STAFF COMMENT.- As detailed in within documents contained within Attachment 6 <br /> 16 historic structure(s) were previously identified on the property in 1993. These <br /> 17 structures no longer possess physical integrity lending them to preservation efforts. <br /> 18 iv. There are no floodplains on the Property; <br /> 19 V. No endangered species have been identified as being on the Property. <br /> 20 STAFF COMMENT.- At this stage of review, staff has determined the master concept <br /> 21 plan appears to address protection of applicable on-site environmental features. <br /> 22 Further review by staff will be necessary, presuming approval of the rezoning <br /> 23 application, to address environmental impacts associated with anticipated <br /> 24 development. <br /> 25 Staff is concerned about fuel storage, and potential impacts arising from a leak, but <br /> 26 the UDO does not contain a measureable standard by which we can regulate. Storage <br /> 27 tanks are permitted through the State. <br /> 28 As presently configured, the Project proposes 6 double-walled concrete encased storage tanks <br /> 29 for fuel, each with a maximum capacity of 40,000 gallons of fuel storage. The permitting of these <br /> 30 underground tanks will be consistent with NC Department of Environmental Quality (NC DEQ) <br /> 31 standards. There are concerns over the potential impact(s) associated with the storage of the <br /> 32 necessary fuel supporting 60 gas pumps/120 gas nozzles that will have to be addressed during <br /> 33 future site plan review and State permitting of the fuel storage tanks. <br /> 34 On October 28, 2020 the applicant provided a response to staff's environmental assessment <br /> 35 review memo focusing on fuel storage and the oil/water separations that have to be included in <br /> 36 the stormwater inlet systems proposed for the Project. This information is contained in <br /> 37 Attachment 1. <br /> 38 Staff and the applicant have recommended the imposition of various condition(s) to address <br /> 39 development impacts as contained in Attachment 9. <br /> 40 <br /> 41 Other pertinent information concerning the proposed MPD-CZ is as follows: <br /> 42 • Future Land Use Map (FLUM) Designation: As previously detailed herein, both parcels <br /> 43 are located within the Commercial-Industrial Transition Activity Node (CITAN). <br />
