21
1 STAFF COMMENT: The application was forwarded to Orange-Alamance Water
2 System and City of Mebane staff. As of the writing of this abstract, staff has not
3 received formal comment(s) from Orange-Alamance staff but have received
4 acknowledgement, via email to the Director, they have capacity to serve the Project.
5 There are memorandums from the County Staff Engineer and City of Mebane in
6 Attachment 4 concerning provision of services.
7 Erosion Control/Stormwater Regulations: The applicant has indicated the project will abide by
8 existing stormwater, Section 6.14, and erosion control, Section 6.15, regulations of the UDO.
9 STAFF COMMENT: There have been numerous public comment(s) made over
10 stormwater runoff impacting adjacent parcels, including the County's Severn Mile
11 Creek Preserve. Staff has also heard complaint(s) from local residents over the
12 Project negatively impacting water quality.
13 The County has nutrient reduction strategies addressing water quality issues
14 consistent with State regulations. Typically these strategies are achieved with the
15 installation/management of stormwater control measures (SCMs).
16 State rules allow developers to pay `offset fees' to aid in meeting these regulations.
17 These fees are part of a `nutrient trading program' allowed under State rules to fund
18 riparian restoration/enhancement projects constructed elsewhere within the
19 watershed. The goal is to promote overall watershed health and compliance with
20 applicable nutrient reduction strategies.
21 Currently, the predominant strategy utilized in the State is the restoration and/or
22 enhancement of riparian forested buffers on agricultural lands.
23 The concern is use of offset payment methods will not address potential impacts to
24 adjacent water features (i.e. streams, wetlands, etc.). While the overall health of the
25 watershed may be `protected', the quality of local waterways could still be negatively
26 impacted.
27 It has been suggested by both staff and local residents the applicant be required to
28 either:
29 • Abide by nutrient reduction strategies as detailed in Section 6.14.7 of the UDO
30 without participation in the State recognized offsite mitigation program; or
31 • Any off-site mitigation has to occur in Orange County near the Property to
32 ensure preservation of local water quality.
33 Staff is supportive of imposing either as a condition.
34 Solid Waste: The applicant has indicated development within the project shall abide by the
35 Orange County Solid Waste Management Ordinance.
36
37 Land Use Buffers/Setbacks: The applicant is proposing:
38 PIN 9854-16-1576:
39 o Northern property line:
40 ■ 40 ft. land use buffer and setback;
