Willing Road, restaurant and gas station on <br /> 5 parcels zoned Neighborhood Commercial (NC-2), <br /> 6 Single-family residential land uses on parcels zoned <br /> 7 R-1; <br /> 8 East: US Highway 70/1-85 Connector Road and Ben <br /> 9 Johnson Road, large undeveloped parcels of <br /> 10 property zoned Agricultural Residential (AR). <br /> 11 MPD Conditional Zoning (CZ) Process: Involves review/action of a rezoning petition and a master <br /> 12 concept development plan allowing for the development of specific land use(s). Applications are <br /> 13 processed in a legislative manner (i.e., does not require sworn testimony or evidence) and <br /> 14 decisions are based on the BOCC's determination that the project is consistent with the purpose <br /> 15 and intent of the Comprehensive Plan. <br /> 16 <br /> 17 As this is a MPD-CZ proposal, a formal site plan is not required to be submitted. Applicants are <br /> 18 required to produce a concept plan consistent with the provisions of Section 6.7 of the Unified <br /> 19 Development Ordinance (UDO). The typical cadence for review is as follows: <br /> 20 First Action — Planning staff schedules a Neighborhood Information Meeting (NIM). <br /> 21 Staff Comment — DONE. This meeting was held in an on-line format on <br /> 22 September 15, 2020. Notes from this meeting are contained within Attachment 5. <br /> 23 Please note, staff held a follow-up information meeting on October 28, 2020 to <br /> 24 review modifications to the application package (i.e. name change, land use <br /> 25 buffer/access management changes, etc.). <br /> 26 • Second Action — The Planning Board reviews the application at a regular meeting and <br /> 27 makes a recommendation to the BOCC. <br /> 28 Staff Comment. The Planning Board completed its review of the Project at its <br /> 29 November 4, 2020 regular meeting, voting unanimously to recommend approval. <br /> 30 • Third Action — The BOCC receives the Planning Board recommendation and makes a <br /> 31 decision at a previously advertised public hearing. <br /> 32 Staff Comment— If the public hearing is held remotely, there is a 24-hour waiting <br /> 33 period required before a decision can be effective per State legislation regarding <br /> 34 virtual/remote meetings. The purpose of the 24-hour waiting period is to allow for <br /> 35 submission of written comments. <br /> 36 Per Section 2.9.2 (F) (3) of the UDO, mutually agreed upon conditions can be imposed as part <br /> 37 this process only if they address: <br /> 38 1. The compatibility of the proposed development with surrounding property, <br /> 39 2. Proposed support facilities (i.e. roadways and access points, parking, pedestrian and <br /> 40 vehicular circulation systems, screening and buffer areas, etc.) and/or <br /> 41 3. All other matters the County may find appropriate or the petitioner may propose. <br />
